AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in penalties and disposition of fines, further
3providing for subsequent convictions of certain offenses.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6503(a) and (a.1) of Title 75 of the
7Pennsylvania Consolidated Statutes are amended to read:

8§ 6503. Subsequent convictions of certain offenses.

9(a) General offenses.--[Every] Except as provided in 
10subsection (a.1), a person convicted of a second or subsequent
11violation of any of the following provisions shall be sentenced
12to pay a fine of not less than $200 nor more than $1,000 or to
13imprisonment for not more than six months, or both:

14Section 1543(a) (relating to driving while operating
15privilege is suspended or revoked) except as set forth in
16subsection (a.1).

17Section 3367 (relating to racing on highways).

18Section 3734 (relating to driving without lights to avoid
19identification or arrest).

1Section 3748 (relating to false reports).

2(a.1) Certain repeat offenses.--[A person convicted of a
3sixth or subsequent offense under section 1543(a) shall be
4sentenced to pay a fine of not less than $1,000 and to
5imprisonment for not less than 30 days but not more than six
6months.] The following apply:

7(1) A person convicted of a sixth, seventh, eighth or
8ninth offense under section 1543(a) shall be sentenced to pay
9a fine of not less than $1,000 and to imprisonment for not
10less than 30 days but not more than six months.

11(2) A person convicted of a tenth or subsequent offense
12under section 1543(a) shall be sentenced to pay a fine of not
13less than $2,500 and to imprisonment for not less than six
14months.

16Section 2. This act shall take effect in 60 days.
