AN ACT
1 Authorizing counties to impose fees on solid waste facilities
2 within the county.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Short title.
6 This act shall be known and may be cited as the County
7 Special Revenue Act.
8 Section 2. Imposition of fees.
9 (a) General rule.--A county may impose upon the operator of
10 each municipal waste landfill or resource recovery facility a
11 fee of $1 per ton of weighed solid waste or $1 per cubic yard of
12 volume-measured solid waste for all solid waste received at a
13 landfill or resource recovery facility that is located or is
14 proposed to be located within the county.
15 (b) County options.--Nothing in this section shall prevent a
16 county from receiving a higher fee or receiving the fee in a
17 different form than provided in this section if the county and
1 the operator of the municipal waste landfill or resource
2 recovery facility agree in writing.
3 (c) Supersede.--The fee imposed by this section shall
4 preempt and supersede any tax imposed on each municipal waste
5 landfill or resource recovery facility under the act of December
6 31, 1965 (P.L.1257, No.511), known as The Local Tax Enabling
7 Act.
8 Section 3. Effective date.
9 This act shall take effect in 90 days.
