                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, further providing for required
     3     background checks for school employment.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6355(b) of Title 23 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6355.  Requirement.
     9     * * *
    10     (b)  Grounds for denying employment.--
    11         (1)  Except as provided in section 6356 (relating to
    12     exceptions), an administrator shall not hire an applicant if
    13     the department verifies that the applicant is named as the
    14     perpetrator of a founded report or is named as the individual
    15     responsible for injury or abuse in a founded report for
    16     school employee. [No]
    17         (2)  Except as set forth in paragraph (3), no individual

     1     who is a school employee on the effective date of this
     2     subchapter shall be required to obtain an official clearance
     3     statement under subsection (a)(1) as a condition of continued
     4     employment.
     5         (3)  Nothing in this subsection shall prevent a private
     6     school from requiring a school employee to obtain an official
     7     clearance statement under subsection (a)(1) as a condition of
     8     continued employment.

    10     Section 2.  This act shall take effect immediately.
