HOUSE BILL

                                     AN ACT

     1  Amending the act of October 1, 1981 (P.L.279, No.94), entitled
     2     "An act providing for shade trees in incorporated towns,"
     3     further providing for the composition of the shade tree
     4     commission.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2 of the act of October 1, 1981 (P.L.279,
     8  No.94), entitled "An act providing for shade trees in
     9  incorporated towns," is amended to read:
    10  Section 2.  Composition of commission.
    11     The commission shall be composed of three residents or five
    12  residents of the incorporated town, who shall be appointed by
    13  the council, and shall serve without compensation. Whenever a
    14  shade tree commission is established by any incorporated town,
    15  the council shall appoint one member for a term of three years,
    16  one for a term of four years, and one for a term of five years.
    17  Whenever the council wishes to expand the commission, the
    18  additional appointments shall be made so that the terms of the


     1  additional members do not expire in the same year. On the
     2  expiration of the term of any commissioner, a successor shall be
     3  appointed by the council to serve for a term of five years.
     4  Vacancies in the office of commissioner shall be filled by the
     5  council for the unexpired term.
     6     Section 2.  This act shall take effect immediately.
