HOUSE BILL

        INTRODUCED BY DeLUCA, WALKO, MELIO, VEON, ORIE, STEVENSON,
           PIPPY, TRELLO, OLASZ, DERMODY, COLAFELLA, COLAIZZO, LAUGHLIN,
           ROBINSON, CASORIO, M. COHEN AND PISTELLA, OCTOBER 30, 1997

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," further providing for contributions or
    12     expenditures by national banks, corporations or
    13     unincorporated associations.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  Section 1633(a) of the act of June 3, 1937
    17  (P.L.1333, No.320), known as the Pennsylvania Election Code,
    18  amended November 26, 1978 (P.L.1313, No.318), is amended to
    19  read:
    20     Section 1633.  Contributions or Expenditures by National
    21  Banks, Corporations or Unincorporated Associations.--
    22     (a)  It is unlawful for any National or State bank, or any
    23  corporation, incorporated under the laws of this or any other

     1  state or any foreign country or any unincorporated association,
     2  except those corporations formed primarily for political
     3  purposes or as a political committee, to make a contribution or
     4  expenditure in connection with the election of any candidate or
     5  for any political purpose whatever [except in connection with
     6  any question to be voted on by the electors of this
     7  Commonwealth]. Furthermore, it shall be unlawful for any
     8  candidate, political committee, or other person to knowingly
     9  accept or receive any contribution prohibited by this section,
    10  or for any officer or any director of any corporation, bank, or
    11  any unincorporated association to consent to any contribution or
    12  expenditure by the corporation, bank or unincorporated
    13  association, as the case may be, prohibited by this section.
