                                     AN ACT

     1  Providing for the repair or elimination of railroad crossings on
     2     State highways.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Repair or elimination of railroad crossings on State
     6                 highways.
     7     (a)  Repair or elimination of railroad crossings by
     8  Department of Transportation.--If the owner of a railroad
     9  crossing on a State highway fails to repair or eliminate that
    10  crossing within 60 days of an order to that effect from the
    11  Pennsylvania Public Utility Commission or, if greater, within
    12  the time limit specified in the commission's order, the
    13  Department of Transportation may make the repairs or eliminate
    14  the crossing. Costs incurred by the department to repair or
    15  eliminate the crossing shall be charged to the owner of the


     1  railroad crossing unless such owner is entitled to reimbursement
     2  under another provision of law.
     3     (b)  Powers of commission not affected.--Nothing in this act
     4  shall be construed to impair, suspend, contract, enlarge, extend
     5  or affect in any manner the powers and duties of the commission
     6  pursuant to 66 Pa.C.S. §§ 2702 (relating to construction,
     7  relocation, suspension and abolition of crossings), 2703
     8  (relating to ejectment in crossing cases) and 2704 (relating to
     9  compensation for damages occasioned by construction, relocation
    10  or abolition of crossings).
    11  Section 2.  Effective date.
    12     This act shall take effect in 60 days.
