AN ACT

Amending the act of August 9, 1955 (P.L.323, No.130), entitled,

2

as amended, "An act relating to counties of the first, third,

3

fourth, fifth, sixth, seventh and eighth classes; amending,

4

revising, consolidating and changing the laws relating

5

thereto; relating to imposition of excise taxes by counties,

6

including authorizing imposition of an excise tax on the

7

rental of motor vehicles by counties of the first class; and

8

providing for regional renaissance initiatives," in county

9

officers, further providing for enumeration of elected

10

officers.

The General Assembly of the Commonwealth of Pennsylvania

12

hereby enacts as follows:

Section 1.  Section 401 of the act of August 9, 1955

14

(P.L.323, No.130), known as The County Code, is amended by

15

adding a subsection to read:

16

Section 401.  Enumeration of Elected Officers.--* * *

17

(f)  The office of jury commissioner may be abolished by

18

referendum at the option of each county whenever electors equal

19

to at least five per centum of the highest vote cast for any

20

office in the county at the last preceding general election

21

shall file a petition with the county board of elections or the

governing body of the county adopts, by a majority vote, a

2

resolution to place such a question on the ballot and a copy of

3

the resolution is filed with the county board of elections for a

4

referendum on the question of abolishing the office of jury

5

commissioner. The referendum shall not take place in any year in

6

which the office of jury commissioner is on the ballot.

Proceedings under this subsection shall be in accordance with

8

the provisions of the act of June 3, 1937 (P.L.1333, No.320),

9

known as the "Pennsylvania Election Code." Upon approval of the

10

referendum the office of jury commissioner shall expire at the

11

completion of the current jury commissioners' terms of office.

Section 2.  This act shall take effect in 60 days.
