                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the Alternative Fuels
     3     Incentive Grant Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7202(b) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 7202.  Alternative Fuels Incentive Grant Fund.

    11     (b)  Expenditures.--
    12         (1)  Moneys from the fund shall be expended by the PEO as
    13     grants to school districts, municipal authorities, political
    14     subdivisions, nonprofit entities and corporations or
    15     partnerships incorporated or registered in this Commonwealth
    16     and to residents of this Commonwealth to meet [60%] 40% of

     1     the expenses relative to retrofitting vehicles to operate on
     2     alternative fuels as either a bi-fuel, dual-fuel or dedicated
     3     vehicle, including the incremental cost of purchase of
     4     dedicated vehicles and to meet [60%] 40% of the cost to
     5     install the necessary fueling equipment. [Two years after the
     6     effective date of this chapter and for every two-year period
     7     thereafter, the grant funding amount offered by the PEO shall
     8     be reduced 10% until it reaches 20% of the retrofit cost
     9     where it will remain until economic or other conditions
    10     warrant it be changed.]
    11         (2)  No more than 5% of the fund may be used to
    12     administer the provisions of this chapter.
    13         (3)  No more than [10%] 15% of the fund may go to any one
    14     school district, municipal authority, political subdivision,
    15     nonprofit entity, corporation or partnership in any one year,
    16     provided that the total amount of grants made to grant
    17     recipients within a political subdivision in a year shall not
    18     exceed [15%] 20% of the fund.
    19     (b.1)  Application periods.--Grant applications shall be
    20  accepted during at least two periods annually and the periods
    21  shall be not less than four months each.

    23     Section 2.  This act shall take effect in 60 days.
