AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for duty of driver in <-- 3 construction and maintenance areas PROVIDING FOR SUSPENSION <-- 4 OF OPERATING PRIVILEGE FOR CERTAIN CONVICTIONS. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 3326 of Title 75 of the Pennsylvania <-- 8 Consolidated Statutes is amended by adding a subsection to read: 9 § 3326. Duty of driver in construction and maintenance areas. 10 * * * 11 (c.1) Suspension of operating privilege.--Whenever a person 12 is convicted for a violation of section 3361 (relating to 13 driving vehicle at safe speed) or 3362 (relating to maximum 14 speed limits) and that offense occurred in a construction or 15 maintenance area manned by workers acting in their official 16 capacity, the court shall, in addition to any other penalty 17 imposed, order the operating privilege of the person suspended
1 for 30 days. A copy of the order shall be transmitted to the 2 department. 3 * * * 4 SECTION 1. TITLE 75 OF THE PENNSYLVANIA CONSOLIDATED <-- 5 STATUTES IS AMENDED BY ADDING A SECTION TO READ: 6 § 1539.1. SUSPENSION OF OPERATING PRIVILEGE FOR CERTAIN 7 CONVICTIONS. 8 (A) GENERAL RULE.--WHENEVER A PERSON IS CONVICTED FOR A 9 VIOLATION OF SECTION 3361 (RELATING TO DRIVING VEHICLE AT SAFE 10 SPEED) OR 3362 (RELATING TO MAXIMUM SPEED LIMITS) FOR TRAVELING 11 IN EXCESS OF FIVE MILES PER HOUR OVER THE POSTED SPEED LIMIT AND 12 THAT OFFENSE OCCURRED IN A CONSTRUCTION OR MAINTENANCE AREA 13 MANNED BY WORKERS ACTING IN THEIR OFFICIAL CAPACITY, THE 14 DEPARTMENT SHALL SUSPEND THE OPERATING PRIVILEGE OF THE PERSON 15 FOR 30 DAYS. 16 (B) SUSPENSION NOT EXCLUSIVE.--SUSPENSION UNDER THIS SECTION 17 IS IN ADDITION TO ANY SUSPENSION MANDATED UNDER SECTION 1535 18 (RELATING TO SCHEDULE OF CONVICTIONS AND POINTS). 19 Section 2.
