AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, providing for forcing a person into a 3 motor vehicle. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 18 of the Pennsylvania Consolidated 7 Statutes is amended by adding a section to read: 8 § 2911. Forcing a person into a motor vehicle. 9 (a) Offense defined.--A person who uses physical force or 10 the threat of physical violence in order to force or attempt to 11 force a person into a motor vehicle without lawful authority or 12 justification to do so commits a misdemeanor of the second 13 degree. 14 (b) Applicability.--This section shall not apply to: 15 (1) a parent, guardian or other lawful custodian of a
1 child or to any person acting with the actual or implied 2 consent of a parent, guardian or lawful custodian, unless 3 such parent, guardian, lawful custodian or other person is 4 acting contrary to an order entered by a court of competent 5 jurisdiction; or 6 (2) a law enforcement officer acting within the scope of 7 that officer's employment. 8 Section 2.
