        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 25, 2002

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for tattooing OR      <--
     3     BODY PIERCING.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6311 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6311.  Tattooing or body piercing.
     9     (A)  OFFENSE.--A person is guilty of a misdemeanor of the      <--
    10  third degree if he tattoos or pierces the body of any person
    11  under the age of 18 years without the [consent of the] parent or
    12  guardian of such person[.] giving consent for the tattooing or    <--
    13  piercing of the person and being present at the time of the
    14  tattooing or piercing of the person.
    15     (B)  DEFINITIONS.--AS USED IN THIS SECTION, THE FOLLOWING      <--
    16  WORDS AND PHRASES SHALL HAVE THE MEANINGS GIVEN TO THEM IN THIS


     1  SUBSECTION:
     2     "BODY PIERCING."  THE PUNCTURING OF A PART OF THE BODY OF A
     3  LIVE HUMAN BEING SO AS TO CREATE A PERMANENT HOLE FOR COSMETIC
     4  PURPOSES. THE TERM DOES NOT INCLUDE EAR PIERCING OR NAIL
     5  PIERCING.
     6     "TATTOOING."  THE PROCESS BY WHICH INDELIBLE MARKS, FIGURES
     7  OR DECORATIVE DESIGNS ARE CREATED BY INSERTION OF NONTOXIC DYES
     8  OR PIGMENTS INTO OR UNDER THE SUBCUTANEOUS PORTION OF THE SKIN
     9  THROUGH THE USE OF NEEDLES OR BY THE PRODUCTION OF SCARS.
    10     Section 2.  This act shall take effect in 60 days.
