                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.899, No.299), entitled
     2     "An act regulating public bathing places, swimming pools,
     3     public bath houses, public and private natatoriums, turkish
     4     bath houses, all places hired for any form of bathing or
     5     swimming, and all related appurtenances; fixing license fees;
     6     providing, in matters of sanitation, cleanliness and safety,
     7     for supervision by the Department of Health; and prescribing
     8     penalties for violations," further providing for definitions
     9     and for certified lifeguards.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 2 of the act of June 23, 1931 (P.L.899,
    13  No.299), known as the Public Bathing Law, is amended by adding a
    14  clause to read:
    15     Section 2.  Definitions, as used in this act:

    17     (7)  A semiprivate swimming establishment shall mean a hotel,
    18  motel, inn, resort or campgrounds which has a facility that is
    19  designed, constructed and/or designated for the primary purpose
    20  of swimming for use by guests.

     1     Section 2.  Section 4.1 of the act is amended by adding a
     2  subsection to read:
     3     Section 4.1.  Certified Lifeguards.--

     5     (c)  An adequate number of lifeguards shall be on duty at a
     6  semiprivate swimming establishment during hours open to guests
     7  of the establishment. Guests who rent a semiprivate swimming
     8  establishment for a private function shall be required to hire
     9  an adequate number of lifeguards for the duration of the private
    10  function.
    11     Section 3.  This act shall take effect in 60 days.
