HOUSE BILL

No. 2066 Session of 1989

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to sell and convey a tract of land
     3     and a right-of-way situate in Canaan Township, Wayne County,
     4     Pennsylvania.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of General Services, with the
     8  approval of the Governor, is hereby authorized and directed on
     9  behalf of the Commonwealth of Pennsylvania to grant and convey
    10  to the Adams Cable Company, for a consideration equal to the
    11  fair market value as determined by an independent appraiser
    12  selected by the Department of General Services, the following
    13  tract of land:
    14     All that certain lot, piece or parcel of land situate, lying
    15  and being in Canaan Township, County of Wayne, and State of
    16  Pennsylvania, bounded and described as follows:
    17     Beginning at an iron pin set said point of beginning being on
    18  the common border line of Canaan Township with Waymart Boro and
    19  being on the common boundary line of lands now or formerly of

     1  Oak Tree Lodge and Pennsylvania State Asylum. Said point of
     2  beginning also being the most northerly corner of lands herein
     3  described; thence along lands now or formerly of Oak Tree Lodge
     4  and Tammaro; south 41 degrees 16 minutes 00 seconds east, 752.93
     5  feet to a monument found on line of lands now or formerly of
     6  Pennsylvania State Asylum Commonwealth of Pennsylvania; thence
     7  along lands now or formerly of Pennsylvania State Asylum
     8  Commonwealth of Pennsylvania the following 3 courses and
     9  distances: (1) south 02 degrees 00 minutes 00 seconds east,
    10  358.29 feet to an iron pin set; (2) south 80 degrees 55 minutes
    11  29 seconds west, 354.54 feet to pole number 146; (3) north 19
    12  degrees, 12 minutes 59 seconds west, 992.75 feet to the point of
    13  beginning.
    14     Containing 6 acres of land more or less as surveyed by Ronald
    15  J. Gruzesky, Registered Land Surveyor.
    16     This deed is conveyed under and subject to the rights of way
    17  of any and all Public Highways and Public Utilities which may be
    18  over and across the same.
    19     Also being conveyed with the above described premises is a 33
    20  foot right-of-way running from State Route 0006 to the westerly
    21  side line of the 6 acre parcel herein described. Said right-of-
    22  way described as follows:
    23     Beginning at a point in the center of State Route 0006 said
    24  point of beginning being the intersection of the centerline of
    25  State Route 0006 with an existing road; thence along the
    26  centerline of an existing road the following 13 courses and
    27  distances: (1) north 21 degrees, 55 minutes 55 seconds east,
    28  106.05 feet to a point; (2) north 34 degrees, 54 minutes 09
    29  seconds east, 186.18 feet to a point; (3) north 03 degrees 58
    30  minutes 55 seconds west 90.32 feet to a point; (4) north 19

     1  degrees 51 minutes 04 seconds west, 98.98 feet to a point; (5)
     2  north 08 degrees 12 minutes 30 seconds east, 90.10 feet to a
     3  point; (6) north 14 degrees 12 minutes 58 seconds west, 93.56
     4  feet to a point; (7) north 17 degrees 35 minutes 50 seconds
     5  west, 132.38 feet to a point; (8) north 18 degrees 55 minutes 33
     6  seconds east, 108.93 feet to a point; (9) north 49 degrees 53
     7  minutes 12 seconds east, 105.53 feet to a point; (10) north 77
     8  degrees 29 minutes 26 seconds east, 102.90 feet to a point; (11)
     9  south 60 degrees 40 minutes 02 seconds east, 164.51 feet to a
    10  point; (12) south 77 degrees 19 minutes 58 seconds east, 131.55
    11  feet to a point; (13) south 76 degrees 39 minutes, 56 seconds
    12  east, 81.25 feet to a point on the westerly side line of the 6
    13  acre parcel described above.
    14     Section 2.  The conveyance shall be made under and subject to
    15  all easements, servitudes and rights of others, including but
    16  not confined to streets, roadways, and rights of any telephone,
    17  telegraph, water, electric, sewer, gas or pipeline companies, as
    18  well as under and subject to any interest, estates or tenancies
    19  vested in third persons, whether or not appearing of record, for
    20  any portion of the land or improvements erected thereon.
    21     Section 3.  The deed of conveyance shall be approved as
    22  provided by law and shall be executed by the Secretary of
    23  General Services in the name of the Commonwealth of
    24  Pennsylvania.
    25     Section 4.  Costs and fees incidental to this conveyance
    26  shall be borne by the grantee.
    27     Section 5.  This act shall take effect immediately.
