AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for parental 4 notification relating to CHILDREN'S INSTITUTIONS AND child <-- 5 day-care facilities in certain circumstances. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The act of June 13, 1967 (P.L.31, No.21), known 9 as the Public Welfare Code, is amended by adding a section <-- 10 SECTIONS to read: <-- 11 SECTION 917. PARENTAL NOTIFICATION.--(A) A CHILDREN'S <-- 12 INSTITUTION THAT PROVIDES CHILD DAY CARE SHALL PROVIDE A PARENT 13 WITH A WRITTEN NOTIFICATION OF THE FACILITY'S INTENT TO NO 14 LONGER PROVIDE CARE OR SERVICES FOR THE PARENT'S CHILD. THE 15 WRITTEN NOTIFICATION SHALL BE HAND-DELIVERED TO THE PARENT AT 16 LEAST THIRTY DAYS PRIOR TO THE LAST DAY OF CARE OR SERVICES 17 INTENDED TO BE PROVIDED TO THE CHILD AND SHALL INDICATE THE
1 REASON GIVEN BY THE FACILITY FOR THE DECISION TO DISCONTINUE 2 CARE OR SERVICES FOR THE CHILD AS WELL AS THE LAST DATE UPON 3 WHICH THE FACILITY SHALL PROVIDE CARE OR SERVICES FOR THE CHILD. 4 (B) A FACILITY SHALL NOT BE REQUIRED TO PROVIDE WRITTEN 5 NOTIFICATION OF ITS INTENT TO NO LONGER PROVIDE CARE OR SERVICES 6 IN CASES WHERE THE CHILD HAS A COMMUNICABLE DISEASE OR OTHERWISE 7 POSES A RISK TO OTHER CHILDREN OR WHERE THE FACILITY MUST CLOSE 8 OR STOP CARE OR SERVICES DUE TO OTHER UNFORESEEN CIRCUMSTANCES. 9 (C) AS USED IN THIS SECTION, THE TERM "SERVICES" SHALL 10 INCLUDE TRANSPORTATION AND ANY OTHER SERVICES OUTLINED IN THE 11 AGREEMENT SIGNED BY THE FACILITY OPERATOR AND THE PARENT. 12 Section 1081. Parental Notification.--(A) A child day care <-- 13 facility shall provide a parent with a written notification of 14 the facility's intent to no longer provide care or services for 15 that parent's child. The written notification shall be hand- 16 delivered to the parent at least thirty days prior to the last 17 day of care or services intended to be provided to the child and 18 shall indicate the reason given by the facility for the decision 19 to discontinue care or services for the child as well as the 20 last date upon which the facility shall provide care or services 21 for the child. As used in this section, the term "services" FOR <-- 22 THE CHILD. 23 (B) A FACILITY SHALL NOT BE REQUIRED TO PROVIDE WRITTEN 24 NOTIFICATION OF ITS INTENT TO NO LONGER PROVIDE CARE OR SERVICES 25 IN CASES WHERE THE CHILD HAS A COMMUNICABLE DISEASE OR OTHERWISE 26 POSES A RISK TO OTHER CHILDREN OR IN CASES WHERE THE FACILITY 27 MUST CLOSE OR STOP CARE OR SERVICES DUE TO OTHER UNFORESEEN 28 CIRCUMSTANCES. 29 (C) AS USED IN THIS SECTION, THE TERM "SERVICES" shall 30 include transportation and any other services outlined in the 19990H2066B2884 - 2 -
1 agreement signed by the facility operator and the parent.
2 Section 2. This act shall take effect in 60 days.
