HOUSE BILL

        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, MAY 30, 1990

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, to sell and convey a tract of land
     3     and a right-of-way situate in Canaan Township, Wayne County,
     4     Pennsylvania.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of General Services, with the
     8  approval of the Governor, is hereby authorized and directed on
     9  behalf of the Commonwealth of Pennsylvania to grant and convey
    10  to the Adams Cable Company, for a consideration equal to the
    11  fair market value as determined by an independent appraiser
    12  selected by the Department of General Services, the following
    13  tract of land:
    14     All that certain lot, piece or parcel of land situate, lying
    15  and being in Canaan Township, County of Wayne, and State of
    16  Pennsylvania, bounded and described as follows:
    17     Beginning at an iron pin set said point of beginning being on  <--
    18  the common border line of Canaan Township with Waymart Boro and


     1  being on the common boundary line of lands now or formerly of
     2  Oak Tree Lodge and Pennsylvania State Asylum. Said point of
     3  beginning also being the most northerly corner of lands herein
     4  described; thence along lands now or formerly of Oak Tree Lodge
     5  and Tammaro; south 41 degrees 16 minutes 00 seconds east, 752.93
     6  feet to a monument found on line of lands now or formerly of
     7  Pennsylvania State Asylum Commonwealth of Pennsylvania; thence
     8  along lands now or formerly of Pennsylvania State Asylum
     9  Commonwealth of Pennsylvania the following 3 courses and
    10  distances: (1) south 02 degrees 00 minutes 00 seconds east,
    11  358.29 feet to an iron pin set; (2) south 80 degrees 55 minutes
    12  29 seconds west, 354.54 feet to pole number 146; (3) north 19
    13  degrees, 12 minutes 59 seconds west, 992.75 feet to the point of
    14  beginning.
    15     Containing 6 acres of land more or less as surveyed by Ronald
    16  J. Gruzesky, Registered Land Surveyor.
    17     BEGINNING AT AN IRON PIN FOUND ON THE COMMON BOUNDARY LINE OF  <--
    18  LANDS NOW OR FORMERLY OF TAMMARO, OAKTREE LODGE, PENNSYLVANIA
    19  STATE ASYLUM COMMONWEALTH OF PENNSYLVANIA AND OTHER LANDS NOW OR
    20  FORMERLY OF PENNSYLVANIA STATE ASYLUM COMMONWEALTH OF
    21  PENNSYLVANIA; SAID POINT OF BEGINNING BEING THE MOST
    22  NORTHEASTERLY CORNER OF LANDS HEREIN DESCRIBED.
    23     THENCE ALONG OTHER LANDS NOW OR FORMERLY OF PENNSYLVANIA
    24  STATE ASYLUM COMMONWEALTH OF PENNSYLVANIA THE FOLLOWING FOUR
    25  COURSES AND DISTANCES: (1) SOUTH 12 DEGREES, 03 MINUTES, 15
    26  SECONDS EAST, 483.00 FEET TO A POINT; (2) SOUTH 80 DEGREES, 55
    27  MINUTES, 29 SECONDS WEST, 226.64 FEET TO A POINT; (3) NORTH 09
    28  DEGREES, 12 MINUTES, 59 SECONDS WEST, 660.00 FEET TO A POINT;
    29  (4) NORTH 80 DEGREES, 53 MINUTES, 03 SECONDS EAST, 91.28 FEET TO
    30  A POINT ON LINE OF LANDS NOW OR FORMERLY OF TAMMARO.

     2  DEGREES, 16 MINUTES, 00 SECONDS EAST, 210.00 FEET TO THE POINT
     3  OF BEGINNING.
     4     CONTAINING 2.97 ACRES OF LAND MORE OR LESS AS SURVEYED BY
     5  RONALD J. GRUZESKY, REGISTERED LAND SURVEYOR.
     6     This deed is conveyed under and subject to the rights of way
     7  of any and all Public Highways and Public Utilities which may be
     8  over and across the same.
     9     Also being conveyed with the above described premises is a 33
    10  foot right-of-way running from State Route 0006 to the westerly
    11  side line of the 6 2.97 acre parcel herein described. Said        <--

    13     Beginning at a point in the center of State Route 0006 said    <--
    14  point of beginning being the intersection of the centerline of

    28     Section 2.  The conveyance shall be made under and subject to
    29  all easements, servitudes and rights of others, including but
    30  not confined to streets, roadways, and rights of any telephone,

     1  telegraph, water, electric, sewer, gas or pipeline companies, as
     2  well as under and subject to any interest, estates or tenancies
     3  vested in third persons, whether or not appearing of record, for
     4  any portion of the land or improvements erected thereon.
     5     Section 3.  The deed of conveyance shall be approved as
     6  provided by law and shall be executed by the Secretary of
     7  General Services in the name of the Commonwealth of
     8  Pennsylvania.
     9     Section 4.  Costs and fees incidental to this conveyance
    10  shall be borne by the grantee.
    11     Section 5.  This act shall take effect immediately.
