                                     AN ACT

     1  Establishing the High Performance Incentive Fund.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  Section 1.  Fund established.
     5     There is hereby established within the Department of Commerce
     6  the High Performance Incentive Fund to provide matching funds
     7  for business assistance and consulting services to qualified
     8  firms entitled to a work force training tax credit under the
     9  provisions of the act of                      (P.L.   , No.   ),
    10  known as the Upgrade Training Tax Credit Act, or have received
    11  written approval for and are participating at the time the funds
    12  are sought in industrial training, industrial retraining or
    13  investments in a lifelong learning program, subject to
    14  appropriation of funds and program criteria as hereinafter
    15  provided. The department may provide funds to any qualified firm


     1  on a matching basis to pay up to 50% of such firm's costs of
     2  acquiring consulting services provided by the Commonwealth or
     3  approved private consultants to assist in improving the firm's
     4  management, production processes or product or service quality.
     5  Qualified firms also shall receive priority consideration for
     6  any other business assistance programs administered by the
     7  department.
     8  Section 2.  Regulations.
     9     The Department of Commerce shall promulgate regulations to
    10  implement the provisions of this act.
    11  Section 3.  Effective date.
    12     This act shall take effect in 60 days.
