AN ACT

Amending Title 44 (Law and Justice) of the Pennsylvania

2

Consolidated Statutes, establishing the Pennsylvania Bureau

3

of Investigation; providing for the transfer of certain

4

powers and duties from the Pennsylvania State Police and the

5

Office of Attorney General; dissolving the Bureau of Criminal

6

Investigation of the Pennsylvania State Police and the Bureau

7

of Criminal Investigations of the Office of Attorney General;

8

and making related repeals.

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

11

Section 1.  Title 44 of the Pennsylvania Consolidated

12

Statutes is amended by adding a part to read:

§ 9301.  Scope of chapter.

This chapter relates to the Pennsylvania Bureau of

11

Investigation.

§ 9302.  Definitions.

13

The following words and phrases when used in this chapter

14

shall have the meanings given to them in this section unless the

15

context clearly indicates otherwise:

16

"Bureau."  The Pennsylvania Bureau of Investigation

17

established in section 9303 (relating to establishment and

18

powers and duties).

19

"Investigation bureau."  The Bureau of Criminal Investigation

20

of the Pennsylvania State Police.

21

"Unit."  The Criminal Investigation Bureau of the Office of

22

Attorney General.

§ 9303.  Establishment and powers and duties.

24

(a)  Establishment.--There is established a Pennsylvania

25

Bureau of Investigation in this Commonwealth.

26

(b)  Powers and duties.--The bureau shall:

27

(1)  Have the powers and duties previously vested in the

28

investigation bureau and the unit.

29

(2)  Have the power to investigate a criminal offense

30

which the Attorney General has the power to prosecute under

section 205 of the act of October 15, 1980 (P.L.950, No.164),

2

known as the Commonwealth Attorneys Act.

(3)  Continue the existing programs relating to drug law

4

enforcement performed by the investigation bureau.

§ 9304.  Dissolutions.

6

Notwithstanding any other provision of law, the investigation

7

bureau and the unit shall be dissolved.

8

§ 9305.  Transfers.

9

(a)  Transfers.--All personnel, allocations, appropriations,

10

equipment, files, records, contracts, agreements, obligations

11

and other materials that are used, employed or expended by the

12

investigation bureau and the unit in connection with the

13

functions transferred by this act shall be transferred to the

14

bureau as if these contracts, agreements and obligations had

15

been incurred or entered into by the bureau.

16

(b)  Requirements.--

17

(1)  All personnel transferred under subsection (a) shall

18

continue in their employment with the bureau with the same

19

pay scales, salaries, wages, seniority benefits, pension

20

rights and other incidents of employment.

21

(2)  The personnel, appropriations, equipment and other

22

items and material transferred by this section shall include

23

an appropriate portion of the general administrative,

24

overhead and supporting personnel, appropriations, equipment

25

and other materials of the Pennsylvania State Police and the

26

Office of Attorney General.

27

Section 2.  Repeals are as follows:

28

(1)  The General Assembly declares that the repeals under

29

paragraph (2) are necessary to effectuate the addition of 44

30

Pa.C.S. Pt. V.

(2)  The following acts and parts of acts are repealed:

(i)  The second sentence of section 206(a) of the act

3

of October 15, 1980 (P.L.950, No.164), known as the

4

Commonwealth Attorneys Act.

5

(ii)  The first sentence of section 15 of the act of

6

June 3, 1919 (P.L.366, No.179), entitled "An act

7

reorganizing the Department of State Police; creating

8

therein a Bureau of Fire Protection; providing for a

9

State Police Force, and defining the powers and duties of

10

the same, including the enforcement of laws relating to

11

game, fish, forestry, and water supply, and certain other

12

laws, and including the collection of information useful

13

for the detection of crime, and the apprehension of

14

criminals; providing for the equipment, maintenance, and

15

transportation of such police; providing for barracks and

16

substations therefor; and prescribing penalties," insofar

17

as it is inconsistent with this act.

18

(iii)  The first sentence of section 710(f) and the

19

second sentence of section 712(a) of the act of April 9,

20

1929 (P.L.177, No.175), known as The Administrative Code

21

of 1929, insofar as they are inconsistent with this act.

22

Section 3.  This act shall take effect in 60 days.
