AN ACT

 

1Providing for airport systems to conduct 50/50 drawings and to
2donate half of ticket sales to a designated eligible
3charitable organization.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Short title.

7This act shall be known and may be cited as the Airport
8System 50/50 Drawing Act.

9Section 2.  Legislative intent.

10The General Assembly hereby declares that raising funds from
11a 50/50 drawing conducted in airport systems located in a county
12of the second class, the net proceeds of which will be used for
13charitable purposes, is in the public interest.

14Section 3.  Definitions.

15The following words and phrases when used in this act shall
16have the meanings given to them in this section unless the
17context clearly indicates otherwise:

18"Airport."  An airport situated in a county of the second

1class and owned and controlled by a public authority created
2under 53 Pa.C.S. Ch. 56 (relating to municipal authorities), the
3former act of June 28, 1935 (P.L.463, No.191), known as the
4Municipality Authorities Act of one thousand nine hundred and
5thirty-five, or under the former act of May 2, 1945 (P.L.382,
6No.164), known as the Municipality Authorities Act of 1945.

7"Airport 50/50 drawing."  A 50/50 drawing that is conducted
8by an airport in accordance with this act.

9"Airport system."  One or more airports as defined in this
10section.

11Section 4.  General rule.

12A person may purchase one or more airport 50/50 drawing
13tickets, and each ticket shall represent one entry in the
14drawing for a winner.  A single ticket shall be randomly chosen
15as the winner after a certain number of tickets are sold or a
16specified time period expires, as designated by the airport.

17Section 5.  Frequency and location.

18An airport 50/50 drawing may be conducted at an airport no
19more than one time per calendar day. Drawings may only be held
20within the spaces of an airport terminal to which the general
21public, including ticketed passengers, regularly have access.

22Section 6.  Distribution.

23The prize amount of an airport 50/50 drawing shall be 50% of
24the total amount collected from the sale of airport 50/50
25drawing tickets. The other 50% of the total amount collected
26from the sale of airport 50/50 drawing tickets shall be donated
27within seven days from the date of the drawing by the airport to
28the designated charitable organization for which the drawing was
29conducted.

30Section 7.  Designated charitable organization.

1The identity of the designated charitable organization for
2which the airport 50/50 drawing is being conducted shall be
3disclosed to all ticket purchasers.

4Section 8.  Eligibility.

5In order to receive proceeds from an airport 50/50 drawing, a
6charitable organization must be in existence and fulfill its
7purposes prior to the airport 50/50 drawing and shall be
8eligible for exemption under section 501(c)(3) of the Internal
9Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. §501(c)(3)). 
10A political subdivision shall not qualify as a charitable
11organization under this act, but an organization formed by a
12political subdivision that is eligible for exemption under
13section 501(c)(3) of the Internal Revenue Code of 1986 shall
14qualify as a charitable organization under this act.

15Section 9.  Unclaimed prizes.

16Any airport 50/50 drawing prize remaining unclaimed by a
17winner 180 days after the drawing shall be donated to the
18designated charitable organization for which the airport 50/50
19drawing was conducted.

20Section 10. Effective date.

21This act shall take effect in 60 days.
