AN ACT 1 Amending the act of December 9, 2002 (P.L.1399, No.174), 2 entitled "An act specifically authorizing collective 3 bargaining between first-level supervisors and their public 4 employer; providing for arbitration in order to settle 5 disputes rather than striking; and requiring compliance with 6 collective bargaining agreements and findings of 7 arbitrators," enlarging the scope of the act. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 102 of the act of December 9, 2002 11 (P.L.1399, No.174), known as the First-Level Supervisor 12 Collective Bargaining Act, is amended to read: 13 Section 102. Definitions. 14 The following words and phrases when used in this act shall 15 have the meanings given to them in this section unless the 16 context clearly indicates otherwise: 17 "Employee organization." An organization of any kind or any 18 agency or employee representation committee or plan in which 19 membership includes public employees and which exists for the
1 purpose, in whole or in part, of dealing with employers 2 concerning grievances, employee-employer disputes, wages, rates 3 of pay, hours of employment or conditions of work, but shall not 4 include any organization which practices discrimination in 5 membership because of race, color, creed, national origin or 6 political affiliation. 7 "First-level supervisor." An employee functioning at the 8 lowest level as a supervisor. 9 "Public employer." Any of the following: 10 (1) The Department of Corrections. 11 (2) The Pennsylvania Turnpike Commission. 12 "Supervisor." Any individual having authority in the 13 interests of the employer to hire, transfer, suspend, layoff, 14 recall, promote, discharge, assign, reward or discipline other 15 employees or responsibility to direct them or adjust their 16 grievances, or to a substantial degree effectively recommend 17 such action if, in connection with the foregoing, the exercise 18 of such authority is not merely routine or clerical in nature 19 but calls for the use of independent judgment. 20 Section 2.
