AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in miscellaneous provisions relating to operation
of vehicles, providing for hayride combination crossings.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 75 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 3724. Hayride combination crossings.
(a) Crossings authorized.--Notwithstanding any other
provisions of this title, a hayride combination may cross a
highway if the following conditions are met:
(1) The crossing is made at an angle of approximately 90
degrees to the direction of the highway and at a place where
no obstruction prevents a quick and safe crossing.
(2) The driver of the hayride combination brings the
hayride combination to a complete stop before crossing the
shoulder or main-traveled way of the highway.
(3) The crossing is made on an undivided highway with no

more than two lanes of traffic.
(4) The crossing is made at a designated hayride
crossing, if required by the department or a local authority
under subsection (b).
(5) The driver of the hayride combination holds a valid
driver's license and yields the right-of-way to all oncoming
traffic.
(6) The same person owns the land on both sides of the
undivided highway where the crossing is made.
(7) The crossing is made between sunrise and sunset.
(b) Designation of hayride combination crossings.--The
department on State-designated highways and local authorities on
highways under their jurisdiction may designate hayride
combination crossings on highways with official traffic-control
signals subject to the following:
(1) The department, or a local authority, may only
designate a hayride combination crossing on a highway at a
location between farms owned by the same person if, in the
discretion of the department or the local authority, as
applicable, the designation is reasonably necessary to
protect the safety of motorists and hayride combination
passengers due to any of the following safety concerns:
(i) Traffic volume of the highway.
(ii) Obstruction or line-of-sight issues that may
limit the ability of a hayride combination to safely
cross the highway.
(iii) The frequency of hayride combination crossings
on the highway.
(2) Official traffic-control signals for hayride
crossings shall conform to uniform standards adopted by the

department.
(c) Liability.--Liability may not be imposed on the
department, any other State agency or a local authority as a
result of designating or not designating a hayride crossing in
accordance with this section.
(d) Applicability.--A hayride combination shall not be
subject to the provisions of 66 Pa.C.S. (relating to public
utilities) when crossing a highway consistent with this section.
(e) Construction.--Nothing contained in this section shall
be construed to prohibit a person from operating a hayride
combination on a highway, if authorized by the department or a
local authority during a special event, special activity,
procession or assemblage, in accordance with section 6109
(relating to specific powers of department and local
authorities).
(f) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Hayride combination." A combination consisting of a tow
vehicle and a single hayride trailer.
"Hayride trailer." A trailer, including a trailer that is
also an implement of husbandry, typically filled with straw or
hay and used to transport passengers:
(1) for amusement purposes on a farm or farms; or
(2) to and from locations on a farm or farms for
convenience, ease of access or for safety purposes.
"Passenger." The term does not include, with respect to a
person seated in a motor vehicle located on a farm, the owner of
the farm, a family member of the owner of the farm, an employee
of the farm or an individual residing on the farm.

"Tow vehicle." A farm vehicle, implement of husbandry, truck
or truck tractor, including a truck or truck tractor bearing a
farm vehicle registration plate, used to pull a hayride trailer
in a hayride combination.
Section 2. This act shall take effect in 60 days.
