                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for duty to give information and
     3     render aid.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3744 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 3744.  Duty to give information and render aid.
     9     (a)  General rule.--The driver of any vehicle involved in an
    10  accident resulting in injury to or death of any person or damage
    11  to any vehicle or other property which is driven or attended by
    12  any person shall give his name, address and the registration
    13  number of the vehicle he is driving, and shall upon request
    14  exhibit his driver's license and information relating to
    15  financial responsibility to any person injured in the accident
    16  or to the driver or occupant of or person attending any vehicle
    17  or other property damaged in the accident and shall give the
    18  information and upon request exhibit the license and information

     1  relating to financial responsibility to any police officer at
     2  the scene of the accident or who is investigating the accident
     3  and shall render to any person injured in the accident
     4  reasonable assistance, including the making of arrangements for
     5  the carrying of the injured person to a physician, surgeon or
     6  hospital for medical or surgical treatment if it is apparent
     7  that treatment is necessary or if requested by the injured
     8  person.
     9     (b)  Report of accident to police.--In the event that none of
    10  the persons specified are in condition to receive the
    11  information to which they otherwise would be entitled under
    12  subsection (a) and no police officer is present, the driver of
    13  any vehicle involved in the accident after fulfilling all other
    14  requirements of section 3742 (relating to accidents involving
    15  death or personal injury) and subsection (a), insofar as
    16  possible on his part to be performed, shall forthwith report the
    17  accident to the nearest office of a duly authorized police
    18  department and submit to the police department the information
    19  specified in subsection (a).
    20     (b.1)  License and financial responsibility information.--
    21         (1)  Notwithstanding any other provision of law, police
    22     departments shall, upon request, furnish at no cost a copy of
    23     any information relating to a person's license or financial
    24     responsibility received under subsection (a) or (b) to all of
    25     the following:
    26             (i)  Any person involved in the accident, his
    27         attorney or insurer.
    28             (ii)  The Federal Government.
    29             (iii)  Branches of the military service.
    30             (iv)  Commonwealth agencies.

     1             (v)  Officials of political subdivisions.
     2             (vi)  Agencies of other states and nations and their
     3         political subdivisions.
     4         (2)  The copy of the information provided under paragraph
     5     (1) shall not be admissible as evidence in any action for
     6     damages or criminal proceedings arising out of a motor
     7     vehicle accident.
     8         (3)  Police departments may refuse to furnish the
     9     information requested under paragraph (1) whenever there are
    10     criminal charges pending against any persons involved in the
    11     vehicle accident unless the Pennsylvania Rules of Criminal
    12     Procedure require the production of the documents.
    13     (c)  Duty of occupants if driver disabled.--Whenever the
    14  driver of a vehicle is physically unable to give the information
    15  or assistance required in this section and there are other
    16  occupants in the vehicle at the time of the accident who are
    17  physically able to give the information or assistance required
    18  in this section, each of the other occupants shall fully reveal
    19  the identity of himself and the identity of the driver of the
    20  vehicle and of the owner of the vehicle of which they are
    21  occupants and shall otherwise perform the duties of the driver
    22  as set forth in subsection (a).
    23     Section 2.  This act shall take effect in 60 days.
