                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," further providing
     6     for rules for the use of highways.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 420, act of June 1, 1945 (P.L.1242,
    10  No.428), known as the "State Highway Law," is amended to read:
    11     Section 420.  Rules for Use of, and Injury to, Highways;
    12  Penalty.--(a)  The secretary is empowered to make reasonable
    13  rules and regulations governing the use of all State highways,
    14  and, by the construction of curbs, divisor strips, painted lines
    15  or signs, may control the direction of the flow of traffic
    16  thereon.
    17     (b)  Any person violating such rules or regulations, or who
    18  shall, by any method or device, or in any manner, wilfully or
    19  maliciously destroy, injure, or damage any such highway in this


     1  Commonwealth, shall, upon summary conviction thereof, be
     2  sentenced to pay a fine of not less than ten dollars ($10.00)
     3  nor more than twenty dollars ($20.00) for each offense, together
     4  with the costs of prosecution, which shall be recovered, as in
     5  similar cases, upon complaint of any person before a magistrate
     6  or justice of the peace, and the fine or fines so recovered
     7  shall be paid into the Motor License Fund.
     8     (c)  The secretary may delegate to any municipality the
     9  department's authority to issue permits for the opening of
    10  driveways onto State highways and for the occupancy of State
    11  highways within their boundaries on terms and conditions
    12  established in department regulations.
    13     Section 2.  This act shall take effect in 60 days.
