AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in safe schools, providing for school
resource officers and equipment.
The General Assembly of the Commonwealth of Pennsylvania
declares that this act shall be known and may be cited as the
School Violence Prevention Act.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1303.2-A. School Resource Officers and Equipment.--
(a) Within one year of the effective date of this section, each
public school entity and nonpublic school shall:
(1) Assign at least one school resource officer to each

school building.
(2) Designate a point or points of entry and exit in each
school building through which each individual must enter and
exit, except in the event of a fire drill, school security drill
or emergency evacuation.
(3) Equip each point of entry and exit under paragraph (2)
with at least one metal detector.
(4) Equip each exterior door of a school building that has
not been designated a point of entry and exit with:
(i) a clearly marked sign designating the door as an
emergency exit only; and
(ii) an audible alarm that sounds when the door is opened.
(b) A school resource officer assigned to a school building
shall:
(1) Be present at all times in the school building during
the school day and extracurricular activities that occur outside
the school day in the school building.
(2) Screen each individual who enters the school building.
(c) A professional employe who has been trained by the
school resource officer to perform the duties under subsection
(b) may perform these duties in lieu of the school resource
officer.
(d) As used in this section:
"Nonpublic school" shall mean a nonprofit school, other than
a public school within this Commonwealth, wherein a resident of
this Commonwealth may legally fulfill the compulsory school
attendance requirements of this act and which meets the
applicable requirements of Title VI of the Civil Rights Act of
1964 (Public Law 88-352, 78 Stat. 241).
"Public school entity" shall mean a school district,

intermediate unit, charter school, regional charter school or
area vocational-technical school.
"School building" shall mean a building owned by or under the
control of a public school entity or nonpublic school where
classes are taught or extracurricular activities are conducted
on a regular basis.
"School resource officer" shall mean an individual who:
(1) Is employed or contracted by a public school entity or
nonpublic school.
(2) Maintains a current and valid certification in the use
and handling of a firearm issued under any of the following:
(i) 53 Pa.C.S. Ch. 21 Subch. D (relating to municipal police
education and training).
(ii) The act of October 10, 1974 (P.L.705, No.235), known as
the "Lethal Weapons Training Act."
(iii) The act of February 9, 1984 (P.L.3, No.2), known as
the "Sheriff and Deputy Sheriff Education and Training Act."
(iv) The act of December 13, 2005 (P.L.432, No.79), known as
the "Retired Law Enforcement Identification Act."
Section 2. This act shall take effect in 60 days.
