                                     AN ACT

     1  Amending Title 35 (Health and Safety) of the Pennsylvania
     2     Consolidated Statutes, further providing for emergency
     3     management services definitions and for radiological
     4     emergencies.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 7102 of Title 35 of the Pennsylvania
     8  Consolidated Statutes is amended by adding definitions to read:
     9  § 7102.  Definitions.
    10     The following words and phrases when used in this part shall
    11  have, unless the context clearly indicates otherwise, the
    12  meanings given to them in this section:
    13     * * *
    14     "Ingestion exposure pathway."  An emergency planning zone
    15  which consists of an area with a radius of at least 75 miles.
    16     * * *

     1     "Plume exposure pathway."  An emergency planning zone for
     2  nuclear generating facilities which consists of an area with a
     3  radius of at least 50 miles.
     4     * * *
     5     "Radiological emergency planning zone."  A zone which
     6  includes, at a minimum:
     7         (1)  an ingestion exposure pathway; and
     8         (2)  a plume exposure pathway.
     9     * * *
    10     Section 2.  Section 7320(a) of Title 35 is amended,
    11  subsection (b) is amended by adding a paragraph and the section
    12  is amended by adding a subsection to read:
    13  § 7320.  Radiological emergency response preparedness, planning
    14             and recovery program.
    15     (a)  Establishment of program.--In addition to the powers and
    16  duties of the agency set forth in section 7313 (relating to
    17  powers and duties), the agency shall develop, establish and
    18  maintain a radiological emergency response preparedness,
    19  planning and recovery program for a radiological emergency
    20  planning zone which is, at a minimum, consistent with the
    21  Commonwealth's Emergency Management Plan and in accordance with
    22  other applicable Federal regulations and State laws for each
    23  nuclear generating facility that has received an operating
    24  license from the Nuclear Regulatory Commission. The exact size
    25  and configuration of a radiological emergency planning zone
    26  surrounding a particular nuclear power reactor shall be
    27  determined in relation to local emergency response needs and
    28  capabilities as they are affected by conditions such as
    29  demography, topography, land characteristics, access routes and
    30  jurisdictional boundaries. Notwithstanding any definitional

     1  differences in Federal statutes or regulations, all applicable
     2  requirements of Federal statutes and regulations regarding
     3  preparedness, planning and recovery shall be applicable to
     4  ingestion exposure pathways and plume exposure pathways.
     5     (b)  Agency functions.--The specific functions of the agency
     6  under the radiological emergency response preparedness, planning
     7  and recovery program shall include, but not be limited to:
     8         * * *
     9         (19)  Providing a World Wide Web site which contains
    10     emergency preparedness, planning and recovery information.
    11     * * *
    12     (e)  Potassium iodide stockpiles.--The agency, in conjunction
    13  with the Department of Health, shall insure that sufficient
    14  stockpiles of potassium iodide tablets are established at public
    15  facilities within at least a 50-mile radius of each nuclear
    16  generating facility. Within 180 days of the effective date of
    17  this subsection, the agency shall either distribute or have
    18  developed a plan for the prompt distribution of the stockpiles
    19  to all individuals located within at least a 50-mile radius of
    20  each nuclear generating facility in the event of a release of
    21  radionuclides.
    22     Section 3.  This act shall take effect in 60 days.
