AN ACT 1 Amending Title 20 (Decedents, Estates and Fiduciaries) of the 2 Pennsylvania Consolidated Statutes, further providing for use 3 of driver's license or identification card to indicate organ 4 or tissue donation. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 8619 of Title 20 of the Pennsylvania 8 Consolidated Statutes is amended to read: 9 § 8619. Use of driver's license or identification card to 10 indicate organ or tissue [donation] donor or 11 recipient. 12 [Beginning as soon as practicable, but no later than January 13 1, 1995, or one year following the effective date of this 14 section, whichever is later, the] The Department of 15 Transportation shall redesign the driver's license and 16 identification card application system to process requests for 17 information regarding [consent]: 18 (1) Consent of the individual to organ or tissue
1 donation. The following question shall be asked: 2 Do you wish to have the organ donor designation printed 3 on your driver's license or identification card? 4 Only an affirmative response of an individual shall be noted on 5 the front of the driver's license or identification card and 6 shall clearly indicate the individual's intent to donate his 7 organs or tissue. A notation on an individual's driver's license 8 or identification card that he intends to donate his organs or 9 tissue is deemed sufficient to satisfy all requirements for 10 consent to organ or tissue donation. 11 (2) Consent of the individual to be a recipient of an 12 organ or tissue donation. The following question shall be 13 asked: 14 Do you wish to have a designation printed on your 15 driver's license or identification card indicating your 16 consent to be a recipient of an organ or tissue donation? 17 Only an affirmative response of an individual shall be noted on 18 the front of the driver's license or identification card and 19 shall clearly indicate the individual's consent to be a 20 recipient of an organ or tissue donation. 21 Section 2. The Department of Transportation shall complete 22 the redesign required under 20 Pa.C.S. § 8619 no later than one 23 year following the effective date of this act. 24 Section 3.
