AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for commercial driver's license. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Section 1610 of Title 75 of the Pennsylvania 6 Consolidated Statutes, amended June 26, 2001 (P.L.734, No.75), 7 is amended to read: 8 § 1610. Commercial driver's license. 9 (a) Content of license.--The commercial driver's license 10 shall indicate "commercial driver's license" or "CDL" and shall 11 include, but not be limited to, the following information: 12 (1) The name and residential address of the person. 13 (2) The person's color photograph or photographic 14 facsimile.
1 (3) A physical description of the person, including sex, 2 height and eye color. 3 (4) Date of birth. 4 (5) The license number assigned by the department. 5 (6) The person's signature or a facsimile of that 6 signature. 7 (7) The class or type of commercial motor vehicle or 8 vehicles which the person is authorized to drive, together 9 with any endorsements or restrictions. 10 (b) Classifications, endorsements and restrictions.-- 11 (1) Commercial drivers' licenses may be issued with the 12 following classifications, endorsements and restrictions. The 13 holder of a valid commercial driver's license may drive all 14 vehicles in the class for which that license is issued and 15 all lesser classes of vehicles except motorcycles. Vehicles 16 requiring an endorsement may not be driven unless the proper 17 endorsement appears on the license. 18 (2) The following codes shall be used as required to 19 describe the commercial driver's license endorsements and 20 restrictions. Additional endorsements and restrictions may be 21 added by regulation for use on the commercial driver's 22 license: 23 H - Authorizes the driver to operate a vehicle 24 transporting hazardous materials. 25 L - Restricts the driver to vehicles not equipped 26 with air brakes. 27 N - Authorizes driving tank vehicles. 28 P - Authorizes driving vehicles carrying passengers. 29 S - Authorizes the driver to operate a school bus. 30 T - Authorizes driving double and triple trailers. 20010H2204B2989 - 2 -
1 X - Represents a combination of hazardous materials 2 and tank vehicle endorsements. 3 (c) Applicant record check.-- 4 (1) Before issuing a commercial driver's license, the 5 department [shall obtain] shall: 6 (i) Obtain driving record information through the 7 Commercial Driver's License Information System and the 8 National Driver Register. 9 (ii) Perform or secure a background check on any 10 applicant whose application is endorsed with an H or X 11 and who has been convicted of a crime involving death or 12 serious bodily injury, significant damage to property of 13 another, terroristic threat or ethnic intimidation. 14 (2) The department may refuse to issue a license under 15 this section on the basis of an unfavorable record check. 16 (d) Notification of license issuance.--When the department 17 has electronic access, but no later than March 31, 1992, the 18 department, within ten days after issuing a commercial driver's 19 license, shall notify the Commercial Driver's License 20 Information System of that fact, providing all information 21 required to ensure identification of the person. 22 (e) License renewal procedures.--When applying for renewal 23 of a commercial driver's license, the applicant must complete 24 the application form required by section 1609(a) (relating to 25 application for commercial driver's license), providing current 26 and valid information and required certifications. If the 27 applicant wishes to retain a hazardous materials endorsement, 28 the English version of the written test for a hazardous 29 materials endorsement must be taken and passed. 30 (f) Sale of photographs prohibited.--Neither the department 20010H2204B2989 - 3 -
1 nor any person under contract with the department shall sell 2 photographs of holders of a commercial driver's license for any 3 commercial purpose. 4 Section 2. This act shall take effect in 60 days. K21L75JLW/20010H2204B2989 - 4 -
