           OF REPRESENTATIVES, AS AMENDED, MARCH 21, 2000

                                     AN ACT

     1  Amending the act of December 4, 1996 (P.L.893, No.141), entitled
     2     "An act providing for volunteer health services; limiting
     3     liability of a volunteer license holder; and requiring
     4     reports," allowing doctors with volunteer licenses to
     5     prescribe medication to family members.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of December 4, 1996 (P.L.893, No.141),
     9  known as the Volunteer Health Services Act, is amended by adding
    10  a section to read:
    11  Section 10.1.  Prescription of medication for family members.
    12     (a)  General rule.--A holder of a volunteer license, who was
    13  able to prescribe medication pursuant to the laws of this
    14  Commonwealth while a licensee, may prescribe medication to
    15  members of his family notwithstanding the family member's


     1  ability to pay for his own care or whether the family members
     2  are being treated at an approved clinic. For purposes of this
     3  section, family members shall be limited to a volunteer license
     4  holder's wife SPOUSE, children, daughters-in-law, sons-in-law,    <--
     5  mother, father, siblings, mother-in-law, father-in-law, sisters-
     6  in-law, brothers-in-law, grandparents, grandchildren or cousins.
     7     (b)  Liability.--The liability provisions of section 7(a)
     8  shall apply to a holder of a volunteer license who prescribes
     9  medication to a family member pursuant to this section, whether
    10  or not the provisions of section 7(b) have been followed.
    11     (c)  Construction.--Nothing in this section shall be
    12  construed to allow a volunteer license holder to prescribe
    13  medication of a type or in a manner prohibited by the laws of
    14  this Commonwealth.
    15     Section 2.  This act shall take effect in 60 days.
