AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, providing for the offenses of assault
3 or aggravated assault of persons desecrating the flag of the
4 United States of America or the flag of Pennsylvania.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 18 of the Pennsylvania Consolidated
8 Statutes is amended by adding a section to read:
9 § 2702.1. Assault and aggravated assault under certain
10 circumstances.
11 Notwithstanding the provisions of sections 2701 (relating to
12 simple assault) and 2702 (relating to aggravated assault) to the
13 contrary, the penalty for commission of an assault or an
14 aggravated assault shall be a fine of $1 if the person against
15 whom the assault or aggravated assault was committed was
16 physically burning, destroying or desecrating the flag of the
17 United States of America or the flag of the Commonwealth of
18 Pennsylvania in public at the time the assault or aggravated
1 assault was committed.
2 Section 2. This act shall take effect immediately.
