AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in miscellaneous provisions relating to operation
of vehicles, further providing for accident scene clearance.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3745.1 of Title 75 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 3745.1. Accident scene clearance.

(f.1) Violation of title or local ordinance.--An owner or
operator of a tow truck that recovers or removes a wrecked or
disabled vehicle from the roadway to a safe refuge on the
shoulder, emergency lane or median at the direction of a police
officer is not in violation of this title or an ordinance of a
local authority for an action performed by the owner or operator
of the tow truck during the recovery or removal of the wrecked
or disabled vehicle if the action was performed at the specific
direction of the police officer.
