AN ACT
1 Amending the act of February 9, 2004 (P.L.61, No.7), entitled
2 "An act providing for a residential neighborhood enhancement
3 program to be administered by the Department of Community and
4 Economic Development; and making an allocation of
5 appropriated funds," further providing for program
6 requirements and for rules and regulations GUIDELINES; and <--
7 repealing the expiration date of the act.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 3(c) of the act of February 9, 2004
11 (P.L.61, No.7), known as the Elm Street Program Act, is amended
12 and the section is amended by adding a subsection to read:
13 Section 3. Elm Street Program.

15 (c) Program requirements.--The program shall:
1 (1) Provide basic grants for [a maximum of] A PERIOD OF <-- 2 UP TO five years per project or upon approval by the 3 department an additional period of up to five years for 4 administrative costs associated with the hiring of a 5 professional Elm Street Manager, who may serve as an 6 assistant to the Main Street Manager if a Main Street Program 7 exists within the municipality. 8 (2) Provide residential reinvestment grants for 9 infrastructure and structural improvements, including, but 10 not limited to, streets, street lights, trees, exteriors of 11 buildings and sidewalks or other pedestrian-oriented 12 features. 13 (3) Provide planning and development grants for: 14 (i) Marketing and promoting urban residential 15 living. 16 (ii) Leveraging additional private and public 17 investment. 18 (iii) Promoting home ownership and other housing 19 options. 20 (iv) Addressing social and economic concerns 21 including, but not limited to, crime, blight, employment 22 opportunities and public services and amenities. 23 (v) Achieving consistency, whenever appropriate, 24 with existing commercial and residential revitalization 25 efforts. 26 (vi) Promoting the development of traditional 27 neighborhood consumer services and goods, including, but 28 not limited to, banking institutions, grocery stores and 29 pharmacies. 30 (4) Provide an assessment of the applying municipality's 20080H2233B3419 - 2 -
1 need for the following: 2 (i) The establishment of a neighborhood improvement 3 district as defined in the act of December 20, 2000 4 (P.L.949, No.130), known as the Neighborhood Improvement 5 District Act. 6 (ii) A review of local comprehensive plans and 7 zoning and other land use ordinances to foster the 8 viability of established residential neighborhoods, with 9 a balanced mix of commercial, civic, employment and 10 residential uses, with particular attention to a 11 diversity of housing options. 12 (iii) A review of educational and recreational 13 opportunities and facilities. 14 * * * 15 (i) Regulations GUIDELINES.--The department shall adopt <-- 16 regulations GUIDELINES to authorize municipalities or their <-- 17 designees, upon the submission of the appropriate applications 18 and the approval of the department, to reestablish an Elm Street 19 program in a neighborhood where a program had been previously 20 established. 21 Section 2. Section 6 of the act is repealed: 22 [Section 6. Expiration of act. 23 This act shall expire June 30, 2011, unless it is reenacted 24 prior to that date.] 25 Section 3.
