AN ACT 1 Amending the act of July 7, 2005 (P.L. , No.1A), entitled "An 2 act to provide from the General Fund for the expenses of the 3 Executive, Legislative and Judicial Departments of the 4 Commonwealth, the public debt and for the public schools for 5 the fiscal year July 1, 2005, to June 30, 2006, for certain 6 institutions and organizations, and for the payment of bills 7 incurred and remaining unpaid at the close of the fiscal year 8 ending June 30, 2005; to provide appropriations from the 9 State Lottery Fund, the Energy Conservation and Assistance
1 Fund, the Hazardous Material Response Fund, The State Stores 2 Fund, the Milk Marketing Fund, the Home Investment Trust 3 Fund, the Emergency Medical Services Operating Fund, the 4 Tuition Payment Fund, the Banking Department Fund, the 5 Firearm Records Check Fund, the Ben Franklin Technology 6 Development Authority Fund, the Tobacco Settlement Fund, the 7 Health Care Provider Retention Account and the Community 8 Health Reinvestment Restricted Account to the Executive 9 Department; to provide appropriations from the Judicial 10 Computer System Augmentation Account to the Judicial 11 Department for the fiscal year July 1, 2005, to June 30, 12 2006; to provide appropriations from the Motor License Fund 13 for the fiscal year July 1, 2005, to June 30, 2006, for the 14 proper operation of the several departments of the 15 Commonwealth and the Pennsylvania State Police authorized to 16 spend Motor License Fund moneys; to provide for the 17 appropriation of Federal funds to the Executive Department of 18 the Commonwealth and for the establishment of restricted 19 receipt accounts for the fiscal year July 1, 2005, to June 20 30, 2006, and for the payment of bills remaining unpaid at 21 the close of the fiscal year ending June 30, 2005; to provide 22 for the additional appropriation of Federal and State funds 23 from the General Fund and the Motor License Fund, for the 24 Executive and Legislative Departments of the Commonwealth for 25 the fiscal year July 1, 2004, to June 30, 2005, and for the 26 payment of bills incurred and remaining unpaid at the close 27 of the fiscal year ending June 30, 2004," reducing the State 28 appropriations for general government operations of the 29 various departments and increasing the Federal and State 30 appropriations for medical assistance - outpatient. 31 The General Assembly of the Commonwealth of Pennsylvania 32 hereby enacts as follows: 33 Section 1. As much of sections 201, 202, 207, 208, 209, 210, 34 211, 212, 213, 214, 215, 216, 217, 218, 219, 220, 221, 222, 223 35 and 229 as relates to general government operations and as much 36 of section 219 as relates to Federal and State appropriations 37 for medical assistance - outpatient in the act of July 7, 2005 38 (P.L. , No.1A), known as the General Appropriation Act of 39 2005, are amended to read: 40 Section 201. The Department of 8 Public Welfare shall not require a 9 recipient to obtain a physician 10 referral in order to receive 11 chiropractic services. The Department 12 of Public Welfare shall not expend or 13 authorize the expenditure of any funds 14 for family planning services in excess 15 of the amounts expended for such 16 services in the 2004-2005 fiscal year 17 and any such funds which are expended 18 shall be subject to the same 19 restrictions contained in the 20 appropriation for grants for women's 21 medical services. The Department of 22 Public Welfare shall not implement the 23 imposition of a monthly premium 24 requirement on the families of 25 category PH-95 disabled children. 26 [State appropriation....... 921,080,000] 27 State appropriation........ 928,385,000 28 The following Federal amounts are 29 appropriated to supplement the sum 30 appropriated for medical assistance - 20050H2244B3171 - 8 -
1 outpatient: 2 (1) "Medical Assistance - 3 Outpatient." The Department of Public 4 Welfare shall not require a recipient 5 to obtain a physician referral in 6 order to receive chiropractic 7 services. The Department of Public 8 Welfare shall not expend or authorize 9 the expenditure of any funds for 10 family planning services in excess of 11 the amounts expended for such services 12 in the 2004-2005 fiscal year and any 13 such funds which are expended shall be 14 subject to the same restrictions 15 contained in the appropriation for 16 grants for women's medical services. 17 The Department of Public Welfare shall 18 not implement the imposition of a 19 monthly premium requirement on the 20 families of category PH-95 disabled 21 children. 22 [Federal appropriation.....1,288,555,000] 23 Federal appropriation......1,297,501,000 24 * * * 25 Section 220. 1 comprehensive and proactive programs 2 coordinating with Federal, State and 3 local law enforcement to remove 4 violent felons, illegal narcotics, 5 illegal weapons and nuisance bars from 6 crime-ridden communities. No 7 Pennsylvania State Police barracks 8 shall be closed until such time as the 9 Pennsylvania State Police conduct a 10 public hearing and provide 30 days' 11 notice which shall be published in the 12 Pennsylvania Bulletin and in at least 13 two local newspapers. 14 [State appropriation....... 137,393,000] 15 State appropriation........ 135,975,000 16 * * * 17 Section 229.
