                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for notice
     6     publication by recognizing the Internet and for emergency
     7     certification to overcome teacher shortages.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 106 of the act of March 10, 1949 (P.L.30,
    11  No.14), known as the Public School Code of 1949, is amended by
    12  adding a subsection to read:
    13     Section 106.  Publication of Notices, etc.; Proofs of
    14  Publication.--* * *
    15     (d)  When so permitted by statute, publication of a notice
    16  may be made on the Department of Education's Internet website or
    17  on the Internet website of a publishing school district. Proof
    18  of such publication shall be provided as prescribed by

     1  regulation. This section shall not apply to a notice that is
     2  required to be published in the Pennsylvania Bulletin.
     3     Section 2.  Section 1109.1 of the act, added June 7, 1993
     4  (P.L.49, No.16), is amended to read:
     5     Section 1109.1.  Emergency Certification in Certain
     6  Instances.--(a)  When the superintendent and board of education
     7  of a school district of the first class find that the supply of
     8  certified teachers is inadequate to the educational needs of the
     9  district's language minority student population or that the loss
    10  of teachers due to early retirement would cause the interruption
    11  of suitable and essential programs of instruction for such
    12  students, the district may, with the permission of the
    13  department, hire otherwise qualified persons without current
    14  teaching certificates, provided that individuals so employed
    15  shall enroll in a teacher certification program and meet
    16  Pennsylvania certification requirements within a period not to
    17  exceed three (3) years.
    18     (b)  If a school district applies to the department for an
    19  emergency permit in order to employ an individual to teach, the
    20  Department of Education shall post this information on its
    21  Internet website for a minimum of thirty (30) days using an
    22  easy-to-find and easy-to-read format in order to provide this
    23  information to the public generally, and to prospective
    24  candidates for the available teaching position specifically.
    25     (c)  An emergency certificate issued under this section may
    26  be renewed for the employed individual should no certified
    27  teacher be employable.
    28     Section 3.  This act shall take effect in 60 days.
