AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in forfeitures, providing
for Pennsylvania Game Commission forfeitures.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 6803. Pennsylvania Game Commission forfeitures.
(a) Motion to return seized property.-- If the Pennsylvania
Game Commission seized the property of an individual who is
suspected of violating a provision of 34 Pa.C.S. (relating to
game) and the individual is found not guilty of the violation,
the individual may file a motion for return of the seized
property under Rule 588 of the Pennsylvania Rules of Criminal
Procedure before the court of common pleas.
(b) Court costs.--If the Pennsylvania Game Commission
opposes the motion and the court grants the motion in favor of
the individual, the court shall order the Pennsylvania Game

Commission to pay the individual's court costs directly related
to the motion.
Section 2. This act shall take effect in 60 days.
