           REPRESENTATIVES, AS AMENDED, MARCH 13, 1990

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for an emergency shortage of petroleum
     3     products.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4964 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4964.  Oral authorization following emergency or accident.
     9     (a)  General rule.--In the event of an emergency or accident
    10  affecting the public safety or convenience, the department and
    11  local authorities may orally authorize the operation or movement
    12  of a vehicle or combination which exceeds the maximum size or
    13  weight specified in this chapter provided a permit is applied
    14  for within 72 hours of the operation or movement.
    15     (b)  Fuel shortages.--If there exists, or is likely to exist,


     1  an emergency shortage of petroleum products or other fuels
     2  pursuant to section 2802-C of the act of April 9, 1929 (P.L.177,
     3  No.175), known as The Administrative Code of 1929, the
     4  department may issue an order temporarily authorizing the
     5  operation or movement of a vehicle or combination carrying or
     6  hauling petroleum products or other fuels which exceeds the
     7  maximum size or weight specified in this chapter WEIGHT           <--
     8  AUTHORIZED UNDER SUBCHAPTER C (RELATING TO MAXIMUM WEIGHTS OF
     9  VEHICLES), without the need to obtain a permit UNDER SUBCHAPTER   <--
    10  D (RELATING TO SPECIAL PERMITS FOR EXCESSIVE SIZE AND WEIGHT).
    11     Section 2.  This act shall take effect immediately.
