AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for retaliation 3 against witness or victim. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 4953 of Title 18 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 4953. Retaliation against a party, witness or victim <-- 9 [WITNESS OR VICTIM] WITNESS, VICTIM OR PARTY. <-- 10 (a) Offense defined.--A person commits an offense if he 11 harms another by any unlawful act or by engaging ENGAGES in a <-- 12 course of conduct or repeatedly committing COMMITS acts which <-- 13 alarm or seriously annoy the victim ANOTHER in retaliation for <-- 14 anything lawfully done in the capacity of witness [or], victim <-- 15 or a party in a civil matter. 16 (b) Grading.--The offense is a felony of the third degree if
1 the retaliation is accomplished by any of the means specified in 2 section 4952(b)(1) through (5) (relating to intimidation of 3 witnesses or victims). Otherwise the offense is a misdemeanor of 4 the second degree. 5 Section 2. This act shall take effect immediately. B1L18WMB/20000H2272B3151 - 2 -
