AN ACT 1 Amending the act of January 23, 1974 (P.L.9, No.4), entitled "An 2 act prescribing the procedure, after the opening of bids, for 3 the withdrawal of bids on certain public contracts, setting 4 forth the rights of the parties involved and providing 5 penalties," further providing for the rewarding of contracts. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 3 of the act of January 23, 1974 (P.L.9, 9 No.4), referred to as the Public Contract Bid Withdrawal Law, is 10 amended to read: 11 Section 3. If a bid is withdrawn in accordance with the 12 provisions of this act, the contracting body may award the 13 contract to the next lowest bidder or reject all bids and 14 resubmit the project for bidding. [In the event the contracting 15 body resubmits the project for bidding the withdrawing bidder 16 shall pay the costs, in connection with the resubmission, of 17 printing new contract documents, required advertising, and 18 printing and mailing notices to prospective bidders, if the 19 contracting authority finds that such costs would not have been
1 incurred but for such withdrawal. In no event shall the 2 withdrawing bidder be permitted to resubmit a bid for the 3 project.] 4 Section 2. This act shall take effect in 60 days. A5L62JLW/20000H2314B3070 - 2 -
