AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for suspension of operating 3 privileges. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1532(b) of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 1532. Suspension of operating privilege. 9 * * * 10 (b) Suspension.-- 11 (1) The department shall suspend the operating privilege 12 of any driver for six months upon receiving a certified 13 record of the driver's conviction of or an adjudication of 14 delinquency based on any offense under the following 15 provisions: 16 Section 3367 (relating to racing on highways). 17 Section 3734 (relating to driving without lights to 18 avoid identification or arrest).
1 Section 3736 (relating to reckless driving). 2 Section 3743 (relating to accidents involving damage 3 to attended vehicle or property). 4 (2) The department shall suspend the operating privilege 5 of any driver for six months upon receiving a certified 6 record of the driver's conviction of a subsequent offense 7 under section 1501(a) (relating to drivers required to be 8 licensed) if the prior offense occurred within five years of 9 the violation date of the subsequent offense. 10 (3) The department shall suspend the operating privilege 11 of any driver for 12 months upon receiving a certified record 12 of the driver's conviction of section 3731 (relating to 13 driving under influence of alcohol or controlled substance) 14 or 3733 (relating to fleeing or attempting to elude police 15 officer), or substantially similar offenses reported to the 16 department under Article III of section 1581 (relating to 17 Driver's License Compact), or an adjudication of delinquency 18 based on section 3731 or 3733. The department shall suspend 19 the operating privilege of any driver for six months upon 20 receiving a certified record of a consent decree granted 21 under 42 Pa.C.S. Ch. 63 (relating to juvenile matters) based 22 on section 3731 or 3733. 23 (4) The department shall suspend the operating privilege 24 of any driver for three months upon receiving a certified 25 record of the driver's conviction of section 1371 (relating 26 to operation following suspension of registration) or an 27 adjudication of delinquency based on section 1371. 28 (5) Notwithstanding paragraph (3), for offenses 29 substantially similar to those defined by section 3731 which 30 are reported to the department under Article III of section 20000H2316B3072 - 2 -
1 1581 (relating to Driver's License Compact), the department 2 shall suspend the driver's operating privilege for a lesser 3 period of time if the driver participated in a program of 4 accelerated rehabilitative disposition or an equivalent in 5 the reporting state and participation in a program of 6 accelerated rehabilitative disposition in this Commonwealth 7 would have resulted in a lesser period of suspension. 8 * * * 9 Section 2.
