AN ACT
1 Amending the act of October 11, 1972 (P.L.909, No.216), entitled
2 "An act providing scholarships for qualified veterans who
3 need financial assistance to complete approved program of
4 education and making an appropriation," further providing for
5 eligibility and financial assistance.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Sections 2 and 4 of the act of October 11, 1972
9 (P.L.909, No.216), known as the Veterans' Education Act of 1971,
10 are amended to read:
11 Section 2. Definitions.--As used in this act:
12 (1) "Qualified veterans" means any [veteran] person who:
13 (i) Served on active duty for a period of more than one
14 hundred eighty days [and part of which accrued after January 31,
15 1955] and who was discharged or released therefrom under
16 conditions other than dishonorable, or who was released or
17 discharged from active duty [after January 31, 1955] for a
18 service-connected disability.
1 (i.1) Serves as a current member of the United States Army 2 Reserve or the Pennsylvania National Guard. 3 (i.2) Has served on active duty for at least one year and 4 would, if being discharged or released from active duty, be 5 eligible for discharge or release under conditions other than 6 dishonorable. 7 (ii) Was a resident of Pennsylvania for at least twelve 8 months immediately preceding his service on active duty[,] or 9 enlistment in the United States Army Reserve or the Pennsylvania 10 National Guard; has continued to reside in Pennsylvania 11 following his discharge or release from active duty, continues 12 to designate Pennsylvania as his official state of residence, or 13 maintains his enlistment in the United States Army Reserve or 14 the Pennsylvania National Guard; and continues to reside in 15 Pennsylvania during the period in which he is enrolled in an 16 institution of higher learning. The agency shall make the final 17 determination in all questions of residency. 18 [(iii) Shall satisfactorily meet the qualification of 19 financial need as determined by uniform standards and procedures 20 to be established by the agency and to be determined without 21 regard to the financial status of their parents unless the 22 agency finds that the applicant is in fact receiving parental 23 financial support.] 24 (2) "Approved program of education" means any degree or non- 25 degree curriculum or course of study [to be pursued on a full- 26 time basis] for a duration of at least two academic years or its 27 equivalent at an approved institution of higher learning. The 28 term includes certifications and degree programs. 29 (3) "Approved institution of higher learning" shall mean any 30 institutions of higher learning approved by the agency. 19880H2325B3090 - 2 -
1 Section 4. Amount of Scholarship.--Scholarships awarded
2 under this act [to cover full-time study] shall not exceed, per
3 academic year, the tuition and fee charges at the institution of
4 higher learning at which the applicant is enrolled or [twelve
5 hundred dollars ($1200)] three thousand dollars ($3,000),
6 whichever is the lesser.
7 Section 2. This act shall take effect in 60 days.
