                                     AN ACT

     1  Amending the act of November 26, 1975 (No.124), entitled "An act
     2     establishing child protective services; providing procedures
     3     for reporting and investigating the abuse of children;
     4     establishing and providing access to a Statewide central
     5     register on child abuse; investigating such reports;
     6     providing for taking protective action including taking a
     7     child into protective custody; placing duties on the
     8     Department of Public Welfare and county child welfare
     9     agencies; establishing child protective services in each
    10     county child welfare agency; and providing penalties,"
    11     requiring reports involving the death of a child to be sent
    12     to the Pennsylvania State Police and the district attorney
    13     and providing for investigation by the Pennsylvania State
    14     Police.

    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Section 10 and clause (3) of section 17, act of
    18  November 26, 1975 (No.124), known as the "Child Protective
    19  Services Law," are amended to read:
    20     Section 10.  Mandatory Reporting and Postmortem Investigation
    21  of Deaths.--Any person or official required to report cases of
    22  suspected child abuse, including employees of a county public
    23  child welfare agency, and its child protective service, who has

     1  reasonable cause to suspect that a child died as a result of
     2  child abuse shall report that fact to the coroner, the
     3  Pennsylvania State Police and the district attorney. The
     4  [coroner] Pennsylvania State Police shall [accept the report
     5  for] conduct an investigation and shall report [his] its finding
     6  to the [police] coroner, the district attorney, the appropriate
     7  child protective service and, if the report is made by a
     8  hospital, the hospital.
     9     Section 17.  Duties of the Child Protective Service
    10  Concerning Reports of Abuse.--Each child protective service
    11  shall:

    13     (3)  Give telephone notice and forward immediately a copy of
    14  reports made pursuant to this act which involve the death of a
    15  child to the Pennsylvania State Police and the appropriate
    16  coroner [pursuant to section 9] and district attorney.

    18     Section 2.  This act shall take effect in 60 days.
