        REFERRED TO COMMITTEE ON JUDICIARY, JANUARY 23, 2006

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for medical
     3     referral civil immunity.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8331.4.  Medical referral civil immunity.
     9     Any physician or any other practitioner of the healing arts
    10  or any registered nurse, licensed by any state, or an employee
    11  thereof, who in good faith refers a patient or potential patient
    12  elsewhere for medical services shall not be liable for civil
    13  damages as a result of any acts or omissions by the physician or
    14  health care services provider to whom the patient or potential
    15  patient was referred.
    16     Section 2.  The addition of 42 Pa.C.S. § 8331.4 shall apply
    17  to causes of action which arise on or after the effective date

     1  of this section.
     2     Section 3.  This act shall take effect in 60 days.
