AN ACT 1 Amending the act of November 4, 1983 (P.L.217, No.63), entitled 2 "An act establishing a program of limited pharmaceutical 3 assistance for the elderly; granting powers to and imposing 4 duties on the Department of Aging; establishing a payment 5 system; making provisions for funding; providing for reports; 6 and fixing penalties for violations of the pharmaceutical 7 assistance program," further defining "income." 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. The definition of "income" in section 3 of the 11 act of November 4, 1983 (P.L.217, No.63), known as the 12 Pharmaceutical Assistance Contract for the Elderly Act, is 13 amended to read: 14 Section 3. Definitions. 15 The following words and phrases when used in this act shall 16 have the meanings given to them in this section unless the 17 context clearly indicates otherwise: 18 * * * 19 "Income." All income from whatever source derived, including
1 but not limited to salaries, wages, bonuses, commissions, income
2 from self-employment, alimony, support money, cash public
3 assistance and relief, the gross amount of any pensions or
4 annuities including railroad retirement benefits, all benefits
5 received under the Federal Social Security Act (except Medicare
6 benefits and less any Medicare payments), all benefits received
7 under State unemployment insurance laws and veterans' disability
8 payments, all interest received from the Federal Government or
9 any state government, or any instrumentality or political
10 subdivision thereof, realized capital gains, rentals, workmen's
11 compensation and the gross amount of loss of time insurance
12 benefits, life insurance benefits and proceeds, except the first
13 $5,000 of the total of death benefits payments, and gifts of
14 cash or property, other than transfers by gift between members
15 of a household, in excess of a total value of $300, but shall
16 not include surplus food or other relief in kind supplied by a
17 government agency or property tax rebate.

19 Section 2. This act shall apply to all payments made under
20 the contracts described in section 5 of the act in 1990 and
21 thereafter.
22 Section 3. This act shall take effect immediately.
