AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and the public schools for the 4 fiscal year July 1, 2008, to June 30, 2009, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2008; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund, the 13 Firearm Records Check Fund, the Ben Franklin Technology 14 Development Authority Fund and the Tobacco Settlement Fund to 15 the Executive Department; to provide appropriations from the 16 Judicial Computer System Augmentation Account to the Judicial 17 Department for the fiscal year July 1, 2008, to June 30, 18 2009; to provide appropriations from the Motor License Fund 19 for the fiscal year July 1, 2008, to June 30, 2009, for the 20 proper operation of the several departments of the 21 Commonwealth and the Pennsylvania State Police authorized to 22 spend Motor License Fund moneys; to provide for the 23 appropriation of Federal funds to the Executive Department of 24 the Commonwealth and for the payment of bills remaining 25 unpaid at the close of the fiscal year ending June 30, 2008; 26 to provide for the additional appropriation of Federal and 27 State funds from the General Fund for the Executive and 28 Judicial Departments of the Commonwealth for the fiscal year 29 July 1, 2007, to June 30, 2008, and for the payment of bills 30 incurred and remaining unpaid at the close of the fiscal year 31 ending June 30, 2007. 32 TABLE OF CONTENTS

1 Section 2001. Effective date. 2 The General Assembly of the Commonwealth of Pennsylvania 3 hereby enacts as follows: 4 PART I 5 GENERAL PROVISIONS 6 Section 101. Short title.--This act shall be known and may 7 be cited as the General Appropriation Act of 2008. 8 Section 102. Definitions.--The following words and phrases 9 when used in this act shall have the meanings given to them in 10 this section unless the context clearly indicates otherwise: 11 "Employees." Includes all directors, superintendents, bureau 12 or division chiefs, assistant directors, assistant 13 superintendents, assistant chiefs, experts, scientists, 14 engineers, surveyors, draftsmen, accountants, secretaries, 15 auditors, inspectors, examiners, analysts, statisticians, 16 marshals, clerks, stenographers, bookkeepers, messengers and 17 other assistants in any department, board or commission. 18 "Expenses" and "maintenance." Includes all printing, binding 19 and stationery, food and forage, materials and supplies, 20 traveling expenses, training, motor vehicle supplies and 21 repairs, freight, express and cartage, postage, telephones and 22 telegraph rentals and toll charges, newspaper advertising and 23 notices, public advertising by or through any medium, fuel, 24 light, heat, power and water, minor construction and renovation, 25 repairs or reconstruction of equipment, buildings and 26 facilities, rent of real estate and equipment, premiums on 27 workers' compensation, insurance premiums on policies of 28 liability insurance, insurance premiums on medical payment 29 insurance and surety bonds for volunteer workers, premiums on 30 employee group life insurance and employee and retired employee 20080H2380B3438 - 8 -
1 group hospital and medical insurance, payment of Commonwealth 2 share of Social Security taxes and unemployment compensation 3 costs for State employees, the purchase of replacement or 4 additional equipment and machinery and all other incidental 5 costs and expenses, including payment to the Department of 6 General Services of mileage and other charges for the use of 7 automobiles and rental payments for permanently assigned 8 automobiles and of expenses or costs of services incurred 9 through the Purchasing Fund. The term "expenses" also shall 10 include the medical costs for the treatment of inmates of State 11 institutions when the inmate must be transferred to an outside 12 hospital, provided, that in no case shall the State institution 13 pay more for patient care than that provided under the State 14 medical assistance program. 15 Section 103. Abbreviations.--The following abbreviations 16 when used in this act shall have the meanings given to them in 17 this section unless the context clearly indicates otherwise: 18 "ARC." State appropriations.--(a) General Fund.--The 19 following sums set forth in this act, or as much thereof as may 20 be necessary, are hereby specifically appropriated from the 21 General Fund to the several hereinafter named agencies of the 22 Executive, Legislative and Judicial Departments of the 23 Commonwealth for the payment of salaries, wages or other 24 compensation and travel expenses of the duly elected or 25 appointed officers and employees of the Commonwealth, for the 26 payment of fees for contractual services rendered, for the 27 purchase or rental of goods and services, printing, public 28 advertising by or through any medium, equipment, land and 29 buildings and for payment of any other expenses, as provided by 30 law or by this act, necessary for the proper conduct of the 20080H2380B3438 - 10 -
1 duties, functions and activities and for the purposes 2 hereinafter set forth for the fiscal year beginning July 1, 3 2008, and for the payment of bills incurred and remaining unpaid 4 at the close of the fiscal year ending June 30, 2008. 5 (b) State Lottery Fund.--The following sums set forth in 6 this act, or as much thereof as may be necessary, are hereby 7 specifically appropriated from the State Lottery Fund to the 8 several hereinafter named agencies of the Executive Department 9 of the Commonwealth for the payment of salaries, wages or other 10 compensation and travel expenses of the duly appointed officers 11 and employees of the Commonwealth, for the payment of fees for 12 contractual services rendered, for the purchase or rental of 13 goods and services and for payment of any other expenses, as 14 provided by law or by this act, necessary for the proper conduct 15 of the duties, functions and activities and for the purposes 16 hereinafter set forth for the fiscal year beginning July 1, 17 2008, and for the payment of bills incurred and remaining unpaid 18 at the close of the fiscal year ending June 30, 2008. 19 (c) Energy Conservation and Assistance Fund.--The following 20 sums set forth in this act, or as much thereof as may be 21 necessary, are hereby specifically appropriated from the Energy 22 Conservation and Assistance Fund to the several hereinafter 23 named agencies of the Executive Department of the Commonwealth 24 for the payment of fees for contractual services rendered, for 25 the purchase or rental of goods and services and for the payment 26 of any other expenses, as provided by law or by this act, 27 necessary for the proper conduct of the duties, functions and 28 activities and for the purposes hereinafter set forth for the 29 fiscal year beginning July 1, 2008, and for the payment of bills 30 incurred and remaining unpaid at the close of the fiscal year 20080H2380B3438 - 11 -
1 ending June 30, 2008. 2 (d) Judicial Computer System Augmentation Account.--The 3 following sums set forth in this act, or as much thereof as may 4 be necessary, are hereby specifically appropriated from the 5 restricted receipt account established within the General Fund, 6 known as the Judicial Computer System Augmentation Account, to 7 the Judicial Department of the Commonwealth for the payment of 8 salaries, wages or other compensation and travel expenses, for 9 the payment of fees for contractual services rendered, for the 10 purchase or rental of goods and services and for the payment of 11 any other expenses, as provided by law or by this act, necessary 12 for the proper conduct of the duties, functions and activities 13 and for the purposes hereinafter set forth for the fiscal year 14 beginning July 1, 2008, and for the payment of bills incurred 15 and remaining unpaid at the close of the fiscal year ending June 16 30, 2008. 17 (e) Emergency Medical Services Operating Fund.--The 18 following sums set forth in this act, or as much thereof as may 19 be necessary, are hereby specifically appropriated from the 20 Emergency Medical Services Operating Fund to the several 21 hereinafter named agencies of the Executive Department of the 22 Commonwealth for the payment of fees for contractual services 23 rendered, for the purchase or rental of goods and services and 24 for the payment of any other expenses, as provided by law or by 25 this act, necessary for the proper conduct of the duties, 26 functions and activities and for the purposes hereinafter set 27 forth for the fiscal year beginning July 1, 2008, and for the 28 payment of bills incurred and remaining unpaid at the close of 29 the fiscal year ending June 30, 2008. 30 (f) The State Stores Fund.--The following sums set forth in 20080H2380B3438 - 12 -
1 this act, or as much thereof as may be necessary, are hereby 2 specifically appropriated from The State Stores Fund to the 3 hereinafter named agency of the Executive Department of the 4 Commonwealth for the payment of salaries, wages or other 5 compensation and travel expenses of the duly appointed officers 6 and employees of the Commonwealth, for the payment of fees for 7 contractual services rendered, for the purchase or rental of 8 goods and services and for the payment of any other expenses, as 9 provided by law or by this act, necessary for the proper conduct 10 of the duties, functions and activities and for the purposes 11 hereinafter set forth for the fiscal year beginning July 1, 12 2008, and for the payment of bills incurred and remaining unpaid 13 at the close of the fiscal year ending June 30, 2008. 14 (g) Motor License Fund.--The following sums, or as much 15 thereof as may be necessary, are hereby appropriated from the 16 Motor License Fund to the hereinafter named agencies of the 17 Executive Department for the payment of salaries, wages and 18 other compensation and travel expenses of the duly elected or 19 appointed officers and employees of the Commonwealth, for 20 contractual services and other expenses necessary for the proper 21 conduct of the duties, functions and activities for the purposes 22 hereinafter set forth for the fiscal year beginning July 1, 23 2008, and for the payment of bills incurred and remaining unpaid 24 at the close of the fiscal year ending June 30, 2008. 25 (h) Aviation Restricted Revenue Account.--The following 26 sums, or as much thereof as may be necessary, are hereby 27 appropriated from the Aviation Restricted Revenue Account in the 28 Motor License Fund to the hereinafter named agencies of the 29 Executive Department for the purposes set forth herein for the 30 fiscal year beginning July 1, 2008, and for the payment of bills 20080H2380B3438 - 13 -
1 incurred and remaining unpaid at the close of the fiscal year 2 ending June 30, 2008. 3 (i) Hazardous Material Response Fund.--The following sums 4 set forth in this act, or as much thereof as may be necessary, 5 are hereby specifically appropriated from the Hazardous Material 6 Response Fund to the several hereinafter named agencies of the 7 Executive Department of the Commonwealth for the payment of fees 8 for contractual services rendered, for the purchase or rental of 9 goods and services and for the payment of any other expenses, as 10 provided by law or by this act, necessary for the proper conduct 11 of the duties, functions and activities and for the purposes 12 hereinafter set forth for the fiscal year beginning July 1, 13 2008, and for the payment of bills incurred and remaining unpaid 14 at the close of the fiscal year ending June 30, 2008. 15 (j) Milk Marketing Fund.--The following sums set forth in 16 this act, or as much thereof as may be necessary, are hereby 17 specifically appropriated from the Milk Marketing Fund to the 18 several hereinafter named agencies of the Executive Department 19 of the Commonwealth for the payment of salaries, wages or other 20 compensation and travel expenses of the duly appointed officers 21 and employees of the Commonwealth, for the payment of fees for 22 contractual services rendered, for the purchase or rental of 23 goods and services and for the payment of any other expenses, as 24 provided by law or by this act, necessary for the proper conduct 25 of the duties, functions and activities and for the purposes 26 hereinafter set forth for the fiscal year beginning July 1, 27 2008, and for the payment of bills incurred and remaining unpaid 28 at the close of the fiscal year ending June 30, 2008. 29 (k) Home Investment Trust Fund.--The following sums set 30 forth in this act, or as much thereof as may be necessary, are 20080H2380B3438 - 14 -
1 hereby specifically appropriated from the Home Investment Trust 2 Fund to the hereinafter named agencies of the Executive 3 Department of the Commonwealth for the payment of salaries, 4 wages or other compensation and travel expenses of the duly 5 appointed officers and employees of the Commonwealth, for the 6 payment of fees for contractual services rendered, for the 7 purchase or rental of goods and services and for the payment of 8 any other expenses, as provided by law or by this act, necessary 9 for the proper conduct of the duties, functions and activities 10 and for the purposes hereinafter set forth for the fiscal year 11 beginning July 1, 2008, and for the payment of bills incurred 12 and remaining unpaid at the close of the fiscal year ending June 13 30, 2008. 14 (l) Tuition Payment Fund.--The following sums set forth in 15 this act, or as much thereof as may be necessary, are hereby 16 specifically appropriated from the Tuition Payment Fund to the 17 hereinafter named agencies of the Executive Department of the 18 Commonwealth for the payment of salaries, wages or other 19 compensation and travel expenses of the duly appointed officers 20 and employees of the Commonwealth, for the payment of fees for 21 contractual services rendered, for the purchase or rental of 22 goods and services and for the payment of any other expenses, as 23 provided by law or by this act, necessary for the proper conduct 24 of the duties, functions and activities and for the purposes 25 hereinafter set forth for the fiscal year beginning July 1, 26 2008, and for the payment of bills incurred and remaining unpaid 27 at the close of the fiscal year ending June 30, 2008. 28 (m) Banking Department Fund.--The following sums set forth 29 in this act, or as much thereof as may be necessary, are hereby 30 specifically appropriated from the Banking Department Fund to 20080H2380B3438 - 15 -

Block grants.--(a) Appropriation.--The 9 following sums set forth in this act, or as much thereof as may 10 be necessary, are hereby specifically appropriated from the 11 block grant (BG) funds to the several hereinafter named agencies 12 of the Executive Department of the Commonwealth for the purposes 13 and under the restrictions for which the funds are provided for 14 the fiscal year beginning July 1, 2008. 15 (b) Small Communities Development Block Grant.--The Small 16 Communities Development Block Grant (SCDBG) is to assist small 17 cities and communities that have a high concentration of 18 impoverished citizens and substandard housing to expand their 19 low-income and moderate-income housing opportunities and to meet 20 community development needs. 21 (c) Community Services Block Grant.--The Community Services 22 Block Grant (CSBG) is to provide a range of services and 23 activities having a measurable and potentially major impact on 24 the causes of poverty in the community or those areas of the 25 community where poverty is a particularly acute problem. In 26 addition, new focus may be placed on the unemployed, both old 27 and new. Local agencies may lower their eligibility requirements 28 for recipients to three months to allow greater flexibility to 29 assure proper consideration of each recipient. 30 (d) Preventive Health and Health Services Block Grant.--The 20080H2380B3438 - 18 -
1 Preventive Health and Health Services Block Grant (PHHSBG) is 2 for the provision of preventive health and other health services 3 related to emergency medical systems, health initiative grants, 4 comprehensive public health, hypertension, fluoridation, health 5 education, risk reduction, home health, rape crisis and domestic 6 violence services. 7 (e) Maternal and Child Health Services Block Grant.--The 8 Maternal and Child Health Services Block Grant (MCHSBG) is to 9 enable states to maintain and strengthen their leadership in 10 planning, promoting, coordinating and evaluating health care for 11 pregnant women, mothers, infants and children, and children with 12 special health care needs and in providing health services for 13 mothers and children who do not have access to adequate health 14 care. 15 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 16 Income Home Energy Assistance Block Grant (LIHEABG) is to help 17 lessen the impact of the high cost of energy on low-income 18 families and individuals, including energy efficiency grants for 19 low-income dwellings. No less than 15% of the LIHEABG funds 20 received shall be used for weatherization. LIHEABG funds 21 received pursuant to a Presidential release of contingency funds 22 shall be exempt from the 15% requirement. 23 (g) Social Services Block Grant.--The Social Services Block 24 Grant (SSBG) is for the provision of social services to eligible 25 persons. 26 (h) Mental Health Services Block Grant.--The Mental Health 27 Services Block Grant (MHSBG) provides funds for the provision of 28 services to adults with serious mental illness or children with 29 serious emotional disturbance. 30 (i) Substance Abuse Block Grant.--The Substance Abuse Block 20080H2380B3438 - 19 -

1 automobiles, the method of making payments from the State 2 Treasury for any purpose or the functioning of any 3 administrative department, board or commission. 4 Section 1742. Compliance with other law before funds 5 available.--No appropriation made by this part to any 6 department, board, commission or agency of the Executive 7 Department shall be available unless and until the department, 8 board, commission or agency has complied with sections 615 and 9 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 10 Administrative Code of 1929. 11 Section 1743. Contracts prerequisite to encumbering or 12 committing funds.--Funds for the purchase of supplies, materials 13 and equipment shall not be deemed to be committed or encumbered 14 until contracts covering the purchase have been entered into 15 with the vendors. 16 Section 1744. Minority business set-asides.--(a) Each 17 department or other instrumentality of the Commonwealth listed 18 in Subpart B authorized to contract for buildings, highways, 19 commodities, equipment, supplies or services shall report to the 20 General Assembly all information pertinent to anticipated 21 procurement needs at the beginning of each fiscal year and each 22 fiscal quarter thereafter. 23 (b) As used in this section, the term "minority business" 24 means a minority business enterprise as defined in the act of 25 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 26 Minority Business Development Authority Act. 27 Section 1745. Appropriation of funds from miscellaneous 28 sources.--(a) In addition to the amounts appropriated by this 29 part, moneys received in payment for food and household supplies 30 furnished to employees and other persons, except inmates, by an 20080H2380B3438 - 180 -
1 institution, and moneys received from the proceeds from the sale 2 of any products of the soil, meats, livestock, timber or other 3 materials sold by the department shall be paid into the General 4 Fund and are hereby appropriated out of the General Fund to the 5 several respective institutions for the operation and 6 maintenance of the institutions. 7 (b) In addition to the amounts appropriated by this part, 8 all moneys received from any other source, except the Federal 9 Government, as contributions for the programs provided herein or 10 as payment for services or materials furnished by one 11 institution to another, except those collections designated as 12 revenues, shall be paid into the General Fund and are hereby 13 appropriated out of the General Fund for the purposes of the 14 respective appropriations. 15 (c) In addition to any funds specifically appropriated by 16 this part, all moneys received by a department or agency of the 17 Commonwealth from any other sources, except the Federal 18 Government, as contributions or supplements to the department or 19 agency for a program or administration of an act included in 20 this part shall be paid into the General Fund and credited to 21 the appropriation for that program or administration of the act. 22 Section 1746. Lapsing of unused funds.--(a) Except as 23 otherwise provided by law or by this section, that part of all 24 appropriations in Part XVII unexpended, uncommitted or 25 unencumbered as of June 30, 2008, shall automatically lapse as 26 of that date. 27 (b) The appropriation in Subpart C to the Judicial 28 Department for the courts of common pleas shall be a continuing 29 appropriation. 30 Section 1747. General Fund repository for Federal funds.-- 14 All moneys received from the Federal Government as contributions 15 or supplements to the departments or agencies of the 16 Commonwealth or the programs herein provided shall be paid into 17 the General Fund. 18 Section 1802. Limitation on encumbering or spending Federal 19 funds.--Federal funds shall be encumbered or spent only to the 20 extent that such funds are estimated as being available during 21 the fiscal year of the Commonwealth. 22 Section 1803. Appropriation of prior unspent Federal 23 funds.--(a) Any Federal money which has been previously 24 appropriated by the General Assembly and authorized or allocated 25 by the Federal Government but remains unspent from prior fiscal 26 years and will not be renewed for fiscal year 2008-2009 is 27 hereby appropriated. 28 (b) The Federal appropriations to the Department of Public 29 Welfare include any prior earnings that may be received during 30 fiscal year 2008-2009. 1 appropriated herein to the Department of Public Welfare, all 2 moneys appropriated from the Federal Government during any 3 previous fiscal year which are expected to be received as 4 reimbursements may be carried forward until June 30, 2009, to 5 the extent that obligations are carried forward. In addition, 6 any reimbursements actually received to support such obligations 7 may also be carried forward. 8 Section 1804. Subgrants between Federal fund 9 appropriations.--Subgrants may be made between appropriations 10 without further approval of the General Assembly. The Secretary 11 of the Budget shall submit a list of subgrants to the chairman 12 and minority chairman of the Appropriations Committee of the 13 Senate and the chairman and minority chairman of the 14 Appropriations Committee of the House of Representatives 15 quarterly. No subgrant to a State agency, however, may be made 16 from a restricted receipt account without a specific 17 appropriation by the General Assembly. 18 Section 1805. Utilization of emergency Federal funds.--(a) 19 Federal funds available for costs and damages resulting from 20 natural disasters or civil disobedience may be added to an 21 appropriation contained in this act or to funds appropriated or 22 may be used for the purposes prescribed by the Federal 23 Government. 24 (b) In addition to the moneys appropriated by this act, all 25 moneys received from the Federal Government for the purpose of 26 disaster assistance or relief, or other moneys received as a 27 direct result of terrorist acts, moneys for homeland security 28 and defense and moneys for avian flu/pandemic preparedness shall 29 be paid into the General Fund and are hereby appropriated out of 30 the General Fund to the departments, boards, commissions or 20080H2380B3438 - 183 -
1 agencies designated by the Governor. 2 (c) In the event of any emergency situation in which the 3 General Assembly cannot act in sufficient time, the Governor is 4 authorized through executive authorization to provide up to 5 $10,000,000 in Federal funds to alleviate the emergency 6 situation. For the purposes of this section, "emergency" is 7 defined as any situation in which there is a chance of or which 8 may result in substantial human suffering. 9 Section 1806. Transfer of funds from TANFBG to CCDFBG and 10 SSBG.--In accordance with Federal law which permits the transfer 11 of funds from the TANFBG to the CCDFBG and SSBG, the Department 12 of Public Welfare, upon approval of the Secretary of the Budget, 13 may make such transfers of funds provided that any such transfer 14 will not result in a deficit in any appropriation from which 15 funds are transferred. The Secretary of the Budget shall provide 16 ten days prior notification of any such transfers to the 17 chairman and the minority chairman of the Appropriations 18 Committee of the Senate and the chairman and minority chairman 19 of the Appropriations Committee of the House of Representatives. 20 PART XIX 21 MISCELLANEOUS PROVISIONS FOR 2008-2009 22 Section 1901. Prior laws unaffected.--Except as provided in 23 section 253, this act is not intended to be inconsistent with or 24 to repeal any provision of any act enacted at this or any prior 25 session of the General Assembly regulating the purchase of 26 supplies, the ordering of printing and binding, the purchase, 27 maintenance and use of automobiles, the method of making 28 payments from the State Treasury for any purpose or the 29 functioning of any administrative department, board or 30 commission. 20080H2380B3438 - 184 -
1 Section 1902. Compliance with other law before funds 2 available.--No appropriation made by this act to any department, 3 board, commission or agency of the Executive Department shall be 4 available unless and until the department, board, commission or 5 agency has complied with sections 615 and 616 of the act of 6 April 9, 1929 (P.L.177, No.175), known as The Administrative 7 Code of 1929. 8 Section 1903. Contracts prerequisite to encumbering or 9 committing funds.--Funds available to agencies, boards, 10 departments, commissions or other governmental entities under 11 this act for the procurement of supplies, services or 12 construction shall not be available for payment of or to be 13 committed to or encumbered for payment of any such procurement 14 unless and until the agency, board, department or other 15 governmental entity has complied with all of the requirements 16 applicable to the procurement that are set out in 62 Pa.C.S. 17 (relating to procurement) and in the policies, procedures and 18 regulations instituted in accordance with that code. 19 Section 1904. Minority business set-asides.--(a) Each 20 department or other instrumentality of the Commonwealth listed 21 in Subpart A of Part II authorized to contract for buildings, 22 highways, commodities, equipment, supplies or services shall 23 report to the General Assembly all information pertinent to 24 anticipated procurement needs at the beginning of each fiscal 25 year and each fiscal quarter thereafter. 26 (b) As used in this section, the term "minority business" 27 means a minority business enterprise as defined in the act of 28 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 29 Minority Business Development Authority Act. 30 Section 1905. Appropriation of funds from miscellaneous 20080H2380B3438 - 185 -
1 sources.--(a) In addition to the amounts appropriated by this 2 act, moneys received in payment for food and household supplies 3 furnished to employees and other persons, except inmates, by an 4 institution and moneys received from the proceeds from the sale 5 of any products of the soil, meats, livestock, timber or other 6 materials sold by the department shall be paid into the General 7 Fund and are hereby appropriated out of the General Fund to the 8 several respective institutions for the operation and 9 maintenance of the institutions. 10 (b) In addition to the amounts appropriated by this act, all 11 moneys received from any other source, except the Federal 12 Government, as contributions for the programs provided herein or 13 as payment for services or materials furnished by one 14 institution to another, except those collections designated as 15 revenues, shall be paid into the General Fund and are hereby 16 appropriated out of the General Fund for the purposes of the 17 respective appropriations. 18 (c) In addition to any funds specifically appropriated by 19 this act, all moneys received by a department or agency of the 20 Commonwealth from any other sources, except the Federal 21 Government, as contributions or supplements to the department or 22 agency for a program or administration of an act included in 23 this act shall be paid into the General Fund and credited to the 24 appropriation for that program or administration of the act. 25 Section 1906. Lapsing of unused funds.--(a) Except as 26 otherwise provided by law or by this section, that part of all 27 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 28 XI, XII, XIII, XIV, XV and XVI unexpended, uncommitted or 29 unencumbered as of June 30, 2009, shall automatically lapse as 30 of that date. 20080H2380B3438 - 186 -
1 (b) The appropriation in Part II to the Department of 2 Community and Economic Development for family savings accounts 3 shall be a continuing appropriation. 4 (c) The appropriation in Part II to the Pennsylvania 5 Emergency Management Agency for April 2005 Disaster - Public 6 Assistance shall be a continuing appropriation. 7 (d) The appropriation in Part II to the Pennsylvania 8 Emergency Management Agency for June 2006 Flood Disaster - 9 Public Assistance shall be a continuing appropriation. 10 (e) The appropriation in Part II to the Pennsylvania 11 Emergency Management Agency for November 2006 Storm Disaster - 12 Public Assistance shall be a continuing appropriation. 13 (f) The appropriation in Part II to the Department of 14 General Services for the printing of the Pennsylvania Manual 15 shall be a continuing appropriation. 16 (g) The appropriations in Part II to the Legislative 17 Department shall be continuing appropriations. 18 (h) The appropriations in Part II to the Supreme Court for 19 the unified judicial security programs shall be a continuing 20 appropriation. 21 Section 1907. Appellate courts appropriation contingency.-- 22 The funds appropriated in Part II to the Supreme, Superior and 23 Commonwealth Courts for justice and judge expenses are 24 contingent upon a vouchered expense account plan being continued 25 by the Supreme Court. 26 Section 1908. Transfer of excess funds.--The Governor may 27 transfer any excess money in those funds receiving proceeds of 28 Commonwealth of Pennsylvania general obligation bonds in excess 29 of the amount necessary for the purposes for which the bonds 30 were issued to the appropriate sinking fund for payment of debt 20080H2380B3438 - 187 -
1 service due on outstanding bonds. If such excess funds, together 2 with any available balance, exceed the amount of debt service 3 remaining to be paid, the funds shall be transferred to the 4 General Fund or to the appropriate special fund responsible for 5 such debt service. 6 PART XX 7 EFFECTIVE DATE 8 Section 2001. Retroactivity.--This act shall be retroactive 9 as follows: 10 (1) The provisions of Part XVII of this act shall be 11 retroactive to July 1, 2007. 12 (2) Except as provided in paragraph (1), if the date of 13 enactment is after July 1, 2008, the remainder of this act 14 shall be retroactive to July 1, 2008. 15 Section 2002.
