                                     AN ACT

     1  Amending the act of June 19, 2002 (P.L.421, No.61), entitled "An
     2     act providing for the transferring of liquefied petroleum
     3     gas, for registration, for fees, for inspection, for records,
     4     for training, for permits and for appeal; establishing the
     5     Liquefied Petroleum Gas Advisory Board; providing for
     6     insurance, for prohibitions and for penalties; and making
     7     repeals," authorizing municipalities that have adopted the
     8     Uniform Construction Code to permit and inspect the
     9     installation of tanks and piping in facilities.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 15(b) of the act of June 19, 2002
    13  (P.L.421, No.61), known as the Propane and Liquefied Petroleum
    14  Gas Act, is amended by adding a paragraph to read:
    15  Section 15.  Preemption of municipal regulations.

    17     (b)  Regulations not to conflict.--

    19         (1.1)  A municipality that has adopted or adopts an
    20     ordinance to administer and enforce a building code under the


     1     Uniform Construction Code shall retain the right and
     2     authority to permit, inspect and regulate the installation of
     3     tanks, piping and appliances within residential, commercial
     4     and industrial facilities unless there is a conflict with
     5     other provisions of the Uniform Construction Code.
