AN ACT
1 Making appropriations to the Trustees of the University of 2 Pennsylvania. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. (A) The following sums, or as much thereof as <-- 6 may be necessary, are hereby appropriated to the Trustees of the 7 University of Pennsylvania for the fiscal year July 1, 2000, to 8 June 30, 2001, for the purposes and in the amounts as shown: 9 (1) For dental clinics........................ $938,000 10 (2) For instruction in the Doctor of Medicine 11 program........................................... 4,034,000 12 (3) For veterinary activities................. 33,083,000 13 (4) For cardiovascular studies................ 500,000 <-- 14 Section 2. Payments to the University of Pennsylvania on 15 account of the appropriations for the items provided in section 16 1 shall be made quarterly by the Secretary of Education on the 17 basis of costs during the fiscal year and shall be conditioned 18 on continuing authority for inclusion on the Board of Trustees
1 of the University of Pennsylvania of a minimum of four persons 2 who are not elected officials and who are appointed by the 3 President pro tempore of the Senate, the Minority Leader of the 4 Senate, the Speaker of the House of Representatives and the 5 Minority Leader of the House of Representatives for terms of 6 office coterminous with that of the respective appointing 7 authority; and shall be further conditioned on these appointees 8 receiving full voting rights as members of the board of 9 trustees. 10 Section 3. The University of Pennsylvania shall provide 11 full, complete and accurate information as may be required by 12 the Department of Education or the chairman or the minority 13 chairman of the Appropriations Committee of the Senate or the 14 chairman or the minority chairman of the Appropriations 15 Committee of the House of Representatives. 16 Section 4. The University of Pennsylvania shall report its 17 revenues and expenditures and present its financial statements 18 in accordance with generally accepted accounting principles and 19 procedures for educational institutions as set forth in the 20 "Higher Education Finance Manual (1975)" and the "Commonwealth 21 of Pennsylvania Budget Instructions for the State System of 22 Higher Education, State-Related Universities and Non-State- 23 Related Colleges and Universities." 24 Section 5. The Trustees of the University of Pennsylvania 25 shall report on forms provided by the Department of Education to 26 both the chairman and minority chairman of the Appropriations 27 Committee of the Senate and the chairman and minority chairman 28 of the Appropriations Committee of the House of Representatives 29 by September 30, 2001, on how State-appropriated funds were 30 expended for fiscal year 2000-2001 to reduce the costs to 20000H2396B3440 - 2 -
1 Pennsylvania resident students or to provide services to 2 Pennsylvania residents. 3 Section 6. This act shall take effect July 1, 2000, or 4 immediately, whichever is later. 5 (4) FOR CARDIOVASCULAR STUDIES.......................632,000 <-- 6 (B) THE SUM OF $219,000 IS HEREBY APPROPRIATED TO THE 7 TRUSTEES OF THE UNIVERSITY OF PENNSYLVANIA FOR THE FISCAL YEAR 8 JULY 1, 2000, TO JUNE 30, 2001, FOR THE GENERAL MAINTENANCE OF 9 THE UNIVERSITY OF PENNSYLVANIA MUSEUM AND THE PURCHASE OF SUCH 10 APPARATUS AND EQUIPMENT AS THE TRUSTEES MAY DEEM NECESSARY FOR 11 THE BEST INTEREST OF THE UNIVERSITY OF PENNSYLVANIA MUSEUM. 12 SECTION 2. (A) PAYMENTS TO THE UNIVERSITY OF PENNSYLVANIA 13 ON ACCOUNT OF THE APPROPRIATIONS FOR THE ITEMS PROVIDED IN 14 SECTION 1(A) SHALL BE MADE QUARTERLY BY THE SECRETARY OF 15 EDUCATION ON THE BASIS OF COSTS DURING THE FISCAL YEAR; SHALL BE 16 CONDITIONED ON CONTINUING AUTHORITY FOR INCLUSION ON THE BOARD 17 OF TRUSTEES OF THE UNIVERSITY OF PENNSYLVANIA OF A MINIMUM OF 18 FOUR PERSONS WHO ARE NOT ELECTED OFFICIALS AND WHO ARE APPOINTED 19 BY THE PRESIDENT PRO TEMPORE OF THE SENATE, THE MINORITY LEADER 20 OF THE SENATE, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES AND 21 THE MINORITY LEADER OF THE HOUSE OF REPRESENTATIVES FOR TERMS OF 22 OFFICE COTERMINOUS WITH THAT OF THE RESPECTIVE APPOINTING 23 AUTHORITY; AND SHALL BE FURTHER CONDITIONED ON THESE APPOINTEES 24 RECEIVING FULL VOTING RIGHTS AS MEMBERS OF THE BOARD OF 25 TRUSTEES. 26 (B) THE UNIVERSITY OF PENNSYLVANIA SHALL PROVIDE FULL, 27 COMPLETE AND ACCURATE INFORMATION AS MAY BE REQUIRED BY THE 28 DEPARTMENT OF EDUCATION OR THE CHAIRMAN OR THE MINORITY CHAIRMAN 29 OF THE APPROPRIATIONS COMMITTEE OF THE SENATE OR THE CHAIRMAN OR 30 THE MINORITY CHAIRMAN OF THE APPROPRIATIONS COMMITTEE OF THE 20000H2396B3440 - 3 -
1 HOUSE OF REPRESENTATIVES. 2 (C) THE UNIVERSITY OF PENNSYLVANIA SHALL REPORT ITS REVENUES 3 AND EXPENDITURES AND PRESENT ITS FINANCIAL STATEMENTS IN 4 ACCORDANCE WITH GENERALLY ACCEPTED ACCOUNTING PRINCIPLES AND 5 PROCEDURES FOR EDUCATIONAL INSTITUTIONS AS SET FORTH IN THE 6 "HIGHER EDUCATION FINANCE MANUAL (1975)" AND THE "COMMONWEALTH 7 OF PENNSYLVANIA BUDGET INSTRUCTIONS FOR THE STATE SYSTEM OF 8 HIGHER EDUCATION, STATE-RELATED UNIVERSITIES AND NON-STATE- 9 RELATED COLLEGES AND UNIVERSITIES." 10 (D) THE TRUSTEES OF THE UNIVERSITY OF PENNSYLVANIA SHALL 11 REPORT ON FORMS PROVIDED BY THE DEPARTMENT OF EDUCATION TO BOTH 12 THE CHAIRMAN AND MINORITY CHAIRMAN OF THE APPROPRIATIONS 13 COMMITTEE OF THE SENATE AND THE CHAIRMAN AND MINORITY CHAIRMAN 14 OF THE APPROPRIATIONS COMMITTEE OF THE HOUSE OF REPRESENTATIVES 15 BY SEPTEMBER 30, 2001, ON HOW STATE-APPROPRIATED FUNDS WERE 16 EXPENDED FOR FISCAL YEAR 2000-2001 TO REDUCE THE COSTS TO 17 PENNSYLVANIA RESIDENT STUDENTS OR TO PROVIDE SERVICES TO 18 PENNSYLVANIA RESIDENTS. 19 SECTION 3. (A) PAYMENTS TO THE UNIVERSITY OF PENNSYLVANIA 20 MUSEUM ON ACCOUNT OF THE APPROPRIATION PROVIDED IN SECTION 1(B) 21 SHALL BE MADE QUARTERLY BY THE EXECUTIVE DIRECTOR OF THE 22 PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION. 23 (B) THE TRUSTEES OF THE UNIVERSITY OF PENNSYLVANIA SHALL 24 PROVIDE FULL, COMPLETE AND ACCURATE INFORMATION AS MAY BE 25 REQUIRED BY THE PENNSYLVANIA HISTORICAL AND MUSEUM COMMISSION OR 26 THE CHAIRMAN OR THE MINORITY CHAIRMAN OF THE APPROPRIATIONS 27 COMMITTEE OF THE SENATE OR THE CHAIRMAN OR THE MINORITY CHAIRMAN 28 OF THE APPROPRIATIONS COMMITTEE OF THE HOUSE OF REPRESENTATIVES. 29 SECTION 4.
