AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, limiting referral of applicants to assigned risk
3 plans.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 1745. Limitation.
9 An insurer shall not refer an applicant for motor vehicle
10 liability insurance to the assigned risk plan solely because
11 liability insurance on the owner's vehicle was previously
12 canceled for failure to make one or more payments, even if the
13 owner did not return the vehicle's registration plates to the
14 department upon cancellation.
15 Section 2. This act shall take effect immediately.
