                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for the passing of streetcars.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 75 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 3315.  Passing streetcars.
     8     (a)  General rule.--Notwithstanding any other provision in
     9  this subchapter, the driver of a vehicle shall not overtake and
    10  pass to the left of any streetcar proceeding in the same
    11  direction, whether actually in motion or temporarily halted to
    12  receive or discharge passengers, if the overtaking or passing
    13  requires driving in a lane normally used by traffic moving in
    14  the opposite direction.
    15     (b)  Passenger safety.--No driver of a vehicle shall overtake
    16  and pass a streetcar that has stopped to receive or discharge


     1  passengers on the side which the passengers board or alight
     2  until the doors of the streetcar are closed and the passengers
     3  that are discharged have reached the side of the highway. Where
     4  a platform or pedestrian zone exists or where traffic is
     5  controlled by a peace officer or a traffic signal, a vehicle
     6  need not be brought to a full stop before passing the streetcar,
     7  but may proceed past the streetcar at a speed not greater than
     8  35 miles per hour and with due caution for the safety of
     9  pedestrians.
    10     (c)  Penalty.--A person who violates this section commits a
    11  summary offense and shall, upon conviction, be sentenced to pay
    12  a fine of $300 or to imprisonment for not more than 30 days, or
    13  both.
    14     Section 2.  This act shall take effect immediately.
