AN ACT
1 Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2 Statutes, further providing for powers and duties of the
3 Department of General Services.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 321 of Title 62 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 321. Powers and duties.
9 (a) General rule.--Except as otherwise specifically provided
10 in this part, the department shall have the following powers and
11 duties:
12 (1) Procure or supervise the procurement of all
13 supplies, services and construction needed by executive
14 agencies and those independent agencies for which the
15 department acts as purchasing agency. Procurement authority
16 may be delegated in writing by the Secretary of General
17 Services.
18 (2) Exercise general supervision and control over all
1 inventories of supplies belonging to executive agencies. 2 (3) Sell, trade or otherwise dispose of surplus supplies 3 belonging to executive or independent agencies. 4 (4) Coordinate programs of executive and independent 5 agencies for the inspection, testing and acceptance of 6 supplies and construction to ensure availability of 7 facilities and to avoid a duplication of functions. 8 (5) Establish and maintain a central office where 9 businesses operating in this Commonwealth may obtain 10 information pertaining to the procurement needs of 11 Commonwealth agencies. 12 (6) Participate in the management and maintenance of a 13 contractor responsibility program in coordination with the 14 Office of the Budget and other agencies as may be directed by 15 the Governor. 16 (7) Receive, assess and respond to all Commonwealth 17 purchase proposals, submitted by any person, for the 18 procurement of supplies, services or construction under this 19 part. The department shall provide notification to the person 20 who submitted the Commonwealth purchase proposal within 60 21 days of receiving the proposal. The notification shall 22 indicate that the department is in receipt of the 23 Commonwealth purchase proposal and that the department will 24 provide a written assessment of the merits of the proposal to 25 the person who submitted the proposal within 90 days of the 26 notice. The department shall provide the following in its 27 assessment of the Commonwealth purchase proposal: 28 (i) A cost benefit analysis of the proposal, 29 including, but not limited to, an estimation of the 30 number of jobs created by the proposal. 20060H2440B3509 - 2 -
1 (ii) The anticipated requirements of the proposal. 2 (iii) A proposed invitation for bids or requests for 3 proposals relating to the proposal. 4 (b) Publication of assessments.--The department shall 5 publish any assessment prepared under this section in the 6 Pennsylvania Bulletin. 7 (c) Definition.--As used in this section, the term 8 "Commonwealth purchase proposal" means a suggestion made to the 9 Department of General Services, which includes a recommendation 10 that the Commonwealth procure a specific supply, service or 11 construction. 12 Section 2.
