AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for school 6 athletics and activities. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 511 of the act of March 10, 1949 (P.L.30, 10 No.14), known as the Public School Code of 1949, is amended by 11 adding a subsection to read: 12 Section 511. School Athletics, Publications, and 13 Organizations.-- 14 * * * 15 (c.1) (1) Beginning July 1, 2006, the school district of 16 residence shall permit district residents enrolled in nonpublic, 17 private or parochial schools of a not-for-profit nature to 18 participate in activities covered under this section. 19 Participants shall be subject to the following conditions:
1 (i) Participation in interscholastic athletics is excluded, 2 although participation in intramural athletics is included. 3 (ii) Participants shall meet the eligibility criteria, or 4 their equivalent, for participation in the activity that applies 5 to students enrolled in the school district. 6 (iii) Participants shall meet the try-out criteria, or their 7 equivalent, for participation in the activity that applies to 8 students enrolled in the school district. 9 (iv) Participants must comply with all policies, rules and 10 regulations, or their equivalent, of the governing organization 11 of the activity. 12 (2) Where the activity requires completion of a physical 13 examination or medical test as a condition of participation and 14 the school district of residence offers such physical 15 examination or medical test to students enrolled in the school 16 district, the school district shall permit a child enrolled in a 17 nonpublic, private or parochial school who wishes to participate 18 in the activity to have access to such physical examination or 19 medical test. The district shall publish the dates and times of 20 such physical examination or medical test in a publication of 21 general circulation in the school district and on its publicly 22 accessible Internet website. 23 Section 2.
