AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," IN EARLY LEARNING PROGRAMS, further <--
6 providing for the definition of "eligible provider" in <--
7 Pennsylvania Pre-K Counts Program. AND FOR DUTIES OF APPROVED <--
8 PROVIDERS.
9 The General Assembly of the Commonwealth of Pennsylvania
10 hereby enacts as follows:
11 Section 1. The definition of "eligible provider" in section
12 1511-D of the act of March 10, 1949 (P.L.30, No.14), known as
13 the Public School Code of 1949, added July 20, 2007 (P.L.278,
14 No.45), is amended to read:
15 Section 1511-D. Definitions.
16 The following words and phrases when used in this subarticle
17 shall have the meanings given to them in this section unless the
18 context clearly indicates otherwise:

2 "Eligible provider." Any of the following entities if the
3 entity complies with all quality program standards established
4 by the Department of Education:
5 (1) A school district.
6 (2) A Head Start program.
7 (3) A nursery school licensed under the act of January
8 28, 1988 (P.L.24, No.11), known as the Private Academic
9 Schools Act.
10 (4) [A] One of the following:
11 (i) Prior to July 1, 2009, a child day care center
12 [or], a group day care home or a registered family day
13 care home that has met or exceeded the standards of STAR
14 2 under the Keystone STARS quality rating system
15 established by the Department of Public Welfare.
16 (ii) After June 30, 2009, a child day care center,
17 group day care home or a registered family day care home
18 that has met or exceeded the standards of STAR 3 under
19 the Keystone STARS quality rating system established by
20 the Department of Public Welfare.

22 SECTION 2. SECTION 1515-D(B) OF THE ACT, ADDED JULY 20, 2007 <--
23 (P.L.278, NO.45), IS AMENDED TO READ:
24 SECTION 1515-D. DUTIES OF APPROVED PROVIDERS.

26 (B) CALCULATION OF AVERAGE DAILY MEMBERSHIP.--AN ELIGIBLE
27 STUDENT SHALL NOT BE INCLUDED IN THE AVERAGE DAILY MEMBERSHIP OR
28 ADJUSTED AVERAGE DAILY MEMBERSHIP OF AN APPROVED PROVIDER FOR
29 THE PURPOSE OF PROVIDING FUNDING ALLOCATIONS PURSUANT TO ARTICLE
30 XXV.

1 Section 2 3. This act shall take effect July 1, 2008, or <--
2 immediately, whichever is later.
