AN ACT

 

1Amending Titles 18 (Crimes and Offenses) and 75 (Vehicles) of
2the Pennsylvania Consolidated Statutes, in other offenses,
3repealing provisions relating to violation of governmental
4rules regarding traffic; and, in rules of the road in
5general, further providing for prohibitions in specified
6places.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 7505 of Title 18 of the Pennsylvania
10Consolidated Statutes is repealed:

11[§ 7505. Violation of governmental rules regarding traffic.

12Each Commonwealth agency shall promulgate rules and
13regulations governing all vehicular traffic at those
14Commonwealth facilities situated upon property of the
15Commonwealth which are within the exclusive jurisdiction of such
16agency including but not limited to regulations governing the
17parking of vehicles upon such property. Whoever violates any of
18the rules and regulations promulgated pursuant to this section
19governing the parking of vehicles shall, upon conviction in a

1summary proceeding, be sentenced to pay a fine not exceeding $5.
2Whoever violates any of the rules and regulations promulgated
3pursuant to this section governing the movement of traffic or
4the operation of vehicles shall, upon conviction in a summary
5proceeding, be sentenced to pay a fine not exceeding $15.]

6Section 2. Section 3353(a)(3) and (e) of Title 75 are
7amended to read:

8§ 3353. Prohibitions in specified places.

9(a) General rule.--Except when necessary to avoid conflict
10with other traffic or to protect the safety of any person or
11vehicle or in compliance with law or the directions of a police
12officer or official traffic-control device, no person shall:

14(3) Park a vehicle:

15(i) Within 50 feet of the nearest rail of a railroad
16crossing.

17(ii) At any place where official signs prohibit
18parking.

19(iii) At any place within the jurisdiction of a
20particular Commonwealth agency, including an agency with
21jurisdiction of the Capitol Complex, where official signs
22prohibit parking. A person who violates this subparagraph
23commits a summary offense and shall, upon conviction, be
24sentenced to pay a fine equal to the fine the person
25would be subject to in the municipality where the offense
26occurred. The Department of General Services shall
27annually publish a schedule of fines in the Pennsylvania
28Bulletin that applies to jurisdictions under this
29subparagraph.

1(e) Penalty.--[Any] Except as set forth in subsection (a)(3)
2(iii), any person violating any provision of this section is
3guilty of a summary offense and shall, upon conviction, be
4sentenced to pay a fine of not more than $50.

5Section 3. This act shall take effect in 60 days.
